Subsection (2) applies where—
a
the parents of a child are domiciled in the same country as each other; and
b
the child has a home with a parent or a home (or homes) with both of them.

The child shall be domiciled in the same country as the child's parents.
3
Where subsection (2) does not apply, the child shall be domiciled in the country with which the child has for the time being the closest connection.
4
In this section, “child” means a person under 16 years of age.
