The Criminal Law (Consolidation) (Scotland) Act 1995 is amended as follows.

In section 22 (presumption as to contents of container), for “Section 127 of the Licensing (Scotland) Act 1976 (presumption as to contents of container)” substitute “ Section 140 of the Licensing (Scotland) Act 2005 (asp 16) (presumption as to liquid contents of containers) ”.

In section 23 (interpretation of Part II), for the definition of “alcohol”, substitute the following definition—

“alcohol” has the meaning given in section 2 of the Licensing (Scotland) Act 2005 (asp 16);
