I113Transfer to Scottish Ministers of certain rail provisions

The Scottish Ministers may, by order, provide for any function of the kind specified in subsection (2) below which they think fit to be carried out by them—
a
instead of the person who, immediately before it was so provided, was responsible for carrying the function out; or
b
concurrently with that person.

That kind of function consists of any statutory function—
a
which relates to the provision or regulation of rail services; and
b
which was immediately before the provision referred to in subsection (1) above carried out by—
i
the Strathclyde Passenger Transport Authority; or
ii
the Strathclyde Passenger Transport Executive.

An order under subsection (1) above may modify any enactment.
