In section 259 (exceptions to the rule that hearsay evidence is inadmissible)—
(a)
in subsection (5), for “before the trial diet” substitute “
by the relevant time
”
,
(b)
after that subsection insert—
“(5A)
In subsection (5) above, “the relevant time” means—
(a)
in the case of proceedings in the High Court—
(i)
not less than 7 days before the preliminary hearing; or
(ii)
such later time, before the trial diet, as the judge may on cause shown allow;
(b)
in any other case, before the trial diet.”.
