and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/1/b" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/1/b" id="section-1-1-b"><Pnumber>b</Pnumber><P3para><Text>at such times as may by regulations be prescribed, further such strategies,</Text></P3para></P3><Text>and the strategy (or combination of strategies) in force from time to time is referred to in the following provisions of this section and in sections 2 and 3 of this Act as an “<Term id="term-accessibility-strategy">accessibility strategy</Term>”.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/2" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/2" id="section-1-2"><Pnumber>2</Pnumber><P2para><Text>An accessibility strategy is a strategy for, over a period prescribed by regulations—</Text><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/2/a" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/2/a" id="section-1-2-a"><Pnumber>a</Pnumber><P3para><Text>increasing the extent to which pupils with a disability can participate in the school’s curriculum or, as the case may be, the schools’ curriculums;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/2/b" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/2/b" id="section-1-2-b"><Pnumber>b</Pnumber><P3para><Text>improving the physical environment of the school, or schools, in relation to which the strategy is prepared for the purpose of increasing the extent to which pupils with a disability are able to take advantage of education and associated services provided or offered by such school or schools; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/2/c" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/2/c" id="section-1-2-c"><Pnumber>c</Pnumber><P3para><Text>improving communication with pupils with a disability and, in particular, improving the communication to pupils with a disability—</Text><P4 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/2/c/i" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/2/c/i" id="section-1-2-c-i"><Pnumber>i</Pnumber><P4para><Text>within a reasonable time; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/2/c/ii" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/2/c/ii" id="section-1-2-c-ii"><Pnumber>ii</Pnumber><P4para><Text>in ways which are determined after taking account of their disabilities and any preferences expressed by them or their parents,</Text></P4para></P4><Text>of information which is provided in writing for pupils, or persons who may be admitted as pupils, who do not have a disability.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/3" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/3" id="section-1-3"><Pnumber>3</Pnumber><P2para><Text>An accessibility strategy shall be in writing.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/4" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/4" id="section-1-4"><Pnumber>4</Pnumber><P2para><Text>Each responsible body shall keep their accessibility strategy under review during the period to which it relates and, if necessary, revise it.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/5" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/5" id="section-1-5"><Pnumber>5</Pnumber><P2para><Text>It is the duty of each responsible body to implement their accessibility strategy.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/6" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/6" id="section-1-6"><Pnumber>6</Pnumber><P2para><Text>The Scottish Ministers may by regulations prescribe services which shall, or services which shall not, be regarded for the purposes of this section as being—</Text><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/6/a" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/6/a" id="section-1-6-a"><Pnumber>a</Pnumber><P3para><Text>education; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/1/6/b" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/1/6/b" id="section-1-6-b"><Pnumber>b</Pnumber><P3para><Text>an associated service.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2002-08-15" ConfersPower="true"><Title> Accessibility strategies: education of children under school age <Abbreviation Expansion="et cetera" xml:lang="la">etc.</Abbreviation> outwith schools</Title><P1 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2" id="section-2"><Pnumber PuncAfter="">2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/1" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/1" id="section-2-1"><Pnumber>1</Pnumber><P2para><Text>Each accessibility strategy prepared by an education authority shall, in relation to each place, other than a school, at which the authority provide school education for pupils, include a strategy for, over a period prescribed by regulations—</Text><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/1/a" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/1/a" id="section-2-1-a"><Pnumber>a</Pnumber><P3para><Text>increasing the extent to which pupils with a disability can participate in the school education provided at that place or those places;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/1/b" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/1/b" id="section-2-1-b"><Pnumber>b</Pnumber><P3para><Text>improving the physical environment of the place, or places, in relation to which the strategy is prepared for the purpose of increasing the extent to which pupils with a disability are able to take advantage of education and associated services provided or offered at such place or places; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/1/c" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/1/c" id="section-2-1-c"><Pnumber>c</Pnumber><P3para><Text>improving communication with pupils with a disability and, in particular, improving the communication to pupils with a disability—</Text><P4 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/1/c/i" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/1/c/i" id="section-2-1-c-i"><Pnumber>i</Pnumber><P4para><Text>within a reasonable time; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/1/c/ii" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/1/c/ii" id="section-2-1-c-ii"><Pnumber>ii</Pnumber><P4para><Text>in ways which are determined after taking account of their disabilities and any preferences expressed by them or their parents,</Text></P4para></P4><Text>of information which is provided in writing for pupils, or persons who may be admitted as pupils, who do not have a disability.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/2" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/2" id="section-2-2"><Pnumber>2</Pnumber><P2para><Text>In subsection (1) above, the references to pupils and to pupils with a disability are references only to persons of that description—</Text><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/2/a" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/2/a" id="section-2-2-a"><Pnumber>a</Pnumber><P3para><Text>who are under school age; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/2/b" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/2/b" id="section-2-2-b"><Pnumber>b</Pnumber><P3para><Text>who are of school age and are travelling people.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/2/3" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/2/3" id="section-2-3"><Pnumber>3</Pnumber><P2para><Text>In subsection (2) above, “<Term id="term-travelling-people">travelling people</Term>” means persons of nomadic habit of life, whatever their race or origin.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2002-08-15" ConfersPower="true"><Title> Accessibility strategies: procedure</Title><P1 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3" id="section-3"><Pnumber PuncAfter="">3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/1" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/1" id="section-3-1"><Pnumber>1</Pnumber><P2para><Text>In preparing their accessibility strategy, a responsible body shall—</Text><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/1/a" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/1/a" id="section-3-1-a"><Pnumber>a</Pnumber><P3para><Text>have regard to the need to allocate adequate resources for implementing the strategy;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/1/b" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/1/b" id="section-3-1-b"><Pnumber>b</Pnumber><P3para><Text>consult such children, parents and young persons as they think fit; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/1/c" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/1/c" id="section-3-1-c"><Pnumber>c</Pnumber><P3para><Text>have regard to any guidance issued by the Scottish Ministers as to—</Text><P4 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/1/c/i" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/1/c/i" id="section-3-1-c-i"><Pnumber>i</Pnumber><P4para><Text>the content of an accessibility strategy;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/1/c/ii" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/1/c/ii" id="section-3-1-c-ii"><Pnumber>ii</Pnumber><P4para><Text>the form in which it is to be produced; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/1/c/iii" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/1/c/iii" id="section-3-1-c-iii"><Pnumber>iii</Pnumber><P4para><Text>the persons to be consulted in its preparation.</Text></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/2" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/2" id="section-3-2"><Pnumber>2</Pnumber><P2para><Text>Any guidance issued for the purposes of subsection (1)(c)(iii) above may refer to persons other than persons whom a responsible body is required, by subsection (1)(b) above, to consult.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/3" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/3" id="section-3-3"><Pnumber>3</Pnumber><P2para><Text>A responsible body shall have regard to any guidance issued by the Scottish Ministers as to compliance with the requirements of section 1(4) of this Act.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/4" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/4" id="section-3-4"><Pnumber>4</Pnumber><P2para><Text>A responsible body shall—</Text><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/4/a" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/4/a" id="section-3-4-a"><Pnumber>a</Pnumber><P3para><Text>as soon as they have prepared an accessibility strategy, provide the Scottish Ministers with a copy of it; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/4/b" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/4/b" id="section-3-4-b"><Pnumber>b</Pnumber><P3para><Text>on being so required by the Scottish Ministers at any time after the body have revised their accessibility strategy, provide them with a copy of the strategy as revised.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/5" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/5" id="section-3-5"><Pnumber>5</Pnumber><P2para><Text>If requested to do so, the responsible body shall—</Text><P3 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/3/5/a" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/3/5/a" id="section-3-5-a"><Pnumber>a</Pnumber><P3para><Text>make a copy of their accessibility strategy available for inspection at such reasonable times as they may determine; and any such statutory instrument is subject to annulment in pursuance of a resolution of the Scottish Parliament.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/5/2" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/5/2" id="section-5-2"><Pnumber>2</Pnumber><P2para><Text>Regulations under this Act may make different provision for different cases and for different classes of case.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/5/3" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/5/3" id="section-5-3"><Pnumber>3</Pnumber><P2para><Text>Before making any regulations under this Act, the Scottish Ministers shall consult such persons as they think fit about the proposed regulations.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2010-10-01" ConfersPower="true"><Title> Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/6" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/6" id="section-6"><Pnumber PuncAfter="">6</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/asp/2002/12/section/6/1" IdURI="http://www.legislation.gov.uk/id/asp/2002/12/section/6/1" id="section-6-1"><Pnumber>1</Pnumber><P2para><Text>In this Act—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-1980-act">the 1980 Act</Term>” means the Education (Scotland) Act 1980 (c.44);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-pupil-with-a-disability">pupil with a disability</Term>” means a person who has a disability for the purposes of the <Substitution ChangeId="key-a619f2c46b259791c0a5f8685b1cb8a8-1435578108289" CommentaryRef="key-a619f2c46b259791c0a5f8685b1cb8a8">Equality Act 2010</Substitution> who—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>is a pupil;</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>may be admitted to a school as a pupil; or</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>being a child who is under school age, may be provided with school education at a place other than a school; and</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-responsible-body">responsible body</Term>” means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>in relation to a school which is managed by an education authority, the education authority;</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>in relation to an independent school, the proprietor;</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>in relation to a school in respect of which the managers are for the time being receiving grants under section 73(c) or (d) of the 1980 Act, the managers of the school;
