eId="part-1-crossheading-regulations"><heading>Regulations</heading><section eId="section-29" uk:target="true"><num>29</num><heading>Regulations relating to care services</heading><subsection eId="section-29-1"><num>(1)</num><content><p>Regulations may impose, in relation to care services, any requirements which the Scottish Ministers think fit for the purposes of this Act and may in particular make any provision such as is mentioned in subsection (2), (7) or (9) below.</p></content></subsection><subsection eId="section-29-2"><num>(2)</num><intro><p>Without prejudice to the generality of subsection (1) above, regulations may—</p></intro><level class="para1" eId="section-29-2-a"><num>(a)</num><content><p>make provision as to the persons who are fit to provide, or act as manager in relation to, a care service;</p></content></level><level class="para1" eId="section-29-2-b"><num>(b)</num><content><p>make provision as to the persons who are fit to be employed in the provision of a care service;</p></content></level><level class="para1" eId="section-29-2-c"><num>(c)</num><content><p>make provision as to the fitness of premises to be used for the provision of a care service;</p></content></level><level class="para1" eId="section-29-2-d"><num>(d)</num><content><p>in relation to child minding, require that no person lives, or is likely to live, at the domestic premises to be used for the provision of the service who is not fit to be in the proximity of children;</p></content></level><level class="para1" eId="section-29-2-e"><num>(e)</num><content><p>make provision for securing the welfare of persons provided with a care service;</p></content></level><level class="para1" eId="section-29-2-f"><num>(f)</num><content><p>make provision as to the management and control of operations carried out in the course of providing a care service;</p></content></level><level class="para1" eId="section-29-2-g"><num>(g)</num><content><p>make provision as to the numbers of persons, or persons of any particular category, working at premises where a care service is provided or for the purposes of an agency providing such a service;</p></content></level><level class="para1" eId="section-29-2-h"><num>(h)</num><content><p>make provision as to the management and training of such persons as are mentioned in paragraph (g) above;</p></content></level><level class="para1" eId="section-29-2-i"><num>(i)</num><content><p>impose requirements as to the financial position of a provider of care services;</p></content></level><level class="para1" eId="section-29-2-j"><num>(j)</num><content><p>require that a person acting as a medical practitioner, or in such other professional capacity as may be specified in the regulations, for persons provided with a care service shall not have a financial interest in that service;</p></content></level><level class="para1" eId="section-29-2-k"><num>(k)</num><content><p>require the provider of a care service to appoint a manager in such circumstances as may be specified in the regulations; or</p></content></level><level class="para1" eId="section-29-2-l"><num>(l)</num><intro><p>require any person to whom subsection (3) below applies—</p></intro><level class="para2" eId="section-29-2-l-i"><num>(i)</num><content><p>to notify the Commission accordingly; and</p></content></level><level class="para2" eId="section-29-2-l-ii"><num>(ii)</num><content><p>to appoint a person to manage the care service in question.</p></content></level></level></subsection><subsection eId="section-29-3"><num>(3)</num><intro><p>This subsection applies to any person appointed as—</p></intro><level class="para1" eId="section-29-3-a"><num>(a)</num><content><p>a receiver of the property of a company which is a person providing a service registered under this Part;</p></content></level><level class="para1" eId="section-29-3-b"><num>(b)</num><content><p>the liquidator or provisional liquidator of such a company;</p></content></level><level class="para1" eId="section-29-3-c"><num>(c)</num><content><p>the supervisor of a voluntary arrangement of such a company under Part I of the Insolvency Act <ref eId="c00018" href="http://www.legislation.gov.uk/id/ukpga/1986/45">1986 (c. 45)</ref> or the administrator of such a company appointed under Part II of that Act; or</p></content></level><level class="para1" eId="section-29-3-d"><num>(d)</num><content><p>the permanent trustee or interim trustee (within the meaning of the Bankruptcy (Scotland) Act <ref eId="c00019" href="http://www.legislation.gov.uk/id/ukpga/1985/66">1985 (c. 66)</ref>) appointed in respect of a person providing a service registered under this Part.</p></content></level></subsection><subsection eId="section-29-4"><num>(4)</num><content><p>Regulations under paragraph (a) of subsection (2) above may, in particular, make provision for prohibiting a person from acting as manager unless registered in, or in a particular part of, a register maintained by the Scottish Social Services Council.</p></content></subsection><subsection eId="section-29-5"><num>(5)</num><content><p>Regulations under paragraph (b) of that subsection may, in particular, make provision for prohibiting a person from working, in the provision of a care service, in any such position as may be specified in the regulations unless registered as is mentioned in subsection (4) above.</p></content></subsection><subsection eId="section-29-6"><num>(6)</num><intro><p>Regulations under paragraph (e) of that subsection may, in particular, make provision—</p></intro><level class="para1" eId="section-29-6-a"><num>(a)</num><intro><p>as to—</p></intro><level class="para2" eId="section-29-6-a-i"><num>(i)</num><content><p>the promotion; and</p></content></level><level class="para2" eId="section-29-6-a-ii"><num>(ii)</num><content><p>the protection,</p></content></level><wrapUp><p>of the health of the persons in question;</p></wrapUp></level><level class="para1" eId="section-29-6-b"><num>(b)</num><content><p>for making available in premises where a care service is provided any service provided under or by virtue of the National Health Service (Scotland) Act <ref eId="c00020" href="http://www.legislation.gov.uk/id/ukpga/1978/29">1978 (c. 29)</ref>; and</p></content></level><level class="para1" eId="section-29-6-c"><num>(c)</num><content><p>as to the control and restraint of such persons.</p></content></level></subsection><subsection eId="section-29-7"><num>(7)</num><intro><p>Regulations may make provision as to how the provision of care services is to be conducted, and such regulations may in particular—</p></intro><level class="para1" eId="section-29-7-a"><num>(a)</num><content><p>make provision as to facilities and particular services to be provided;</p></content></level><level class="para1" eId="section-29-7-b"><num>(b)</num><content><p>make provision as to the keeping of accounts;</p></content></level><level class="para1" eId="section-29-7-c"><num>(c)</num><content><p>make provision as to the keeping of documents and records;</p></content></level><level class="para1" eId="section-29-7-d"><num>(d)</num><content><p>require a person providing a care service to make returns to the Commission at such intervals as may be specified in the regulations;</p></content></level><level class="para1" eId="section-29-7-e"><num>(e)</num><content><p>make provision as to the contents of a return made by virtue of paragraph (d) above and the period in respect of which and date by which the return is to be made;</p></content></level><level class="para1" eId="section-29-7-f"><num>(f)</num><intro><p>make provision as to the notification of any event—</p></intro><level class="para2" eId="section-29-7-f-i"><num>(i)</num><content><p>arising out of or in the course of; or</p></content></level><level class="para2" eId="section-29-7-f-ii"><num>(ii)</num><content><p>occurring in relation to,</p></content></level><wrapUp><p>the provision of a care service;</p></wrapUp></level><level class="para1" eId="section-29-7-g"><num>(g)</num><content><p>require the giving of notice by the person providing a care service of any period during which the manager of the service proposes to be absent;</p></content></level><level class="para1" eId="section-29-7-h"><num>(h)</num><content><p>specify the information to be supplied in giving such notice as is mentioned in paragraph (g) above;</p></content></level><level class="para1" eId="section-29-7-i"><num>(i)</num><content><p>provide for the making of adequate arrangements for the running of a care service during any period when the manager is absent;</p></content></level><level class="para1" eId="section-29-7-j"><num>(j)</num><content><p>require the person providing a care service to give notice of any change in the identity of the manager;</p></content></level><level class="para1" eId="section-29-7-k"><num>(k)</num><intro><p>without prejudice to paragraph (m) below, require—</p></intro><level class="para2" eId="section-29-7-k-i"><num>(i)</num><content><p>the person providing a care service to give notice of any intended change which will result in the service being provided, instead, by a different person; or</p></content></level><level class="para2" eId="section-29-7-k-ii"><num>(ii)</num><content><p>where an unforeseen change has had the result mentioned in sub-paragraph (i) above, the person who in consequence of that change is providing a care service to give notice accordingly;</p></content></level></level><level class="para1" eId="section-29-7-l"><num>(l)</num><content><p>where an individual who has been providing a care service dies and no other person is providing the service, require the personal representatives of the individual to give notice of the death;</p></content></level><level class="para1" eId="section-29-7-m"><num>(m)</num><intro><p>require the person providing a care service, if that person is—</p></intro><level class="para2" eId="section-29-7-m-i"><num>(i)</num><content><p>a body corporate, to give notice of any change in the ownership of the body or of the identity of its officers; or</p></content></level><level class="para2" eId="section-29-7-m-ii"><num>(ii)</num><content><p>a firm, to give notice of any change in the identity of the persons who are its partners;</p></content></level></level><level class="para1" eId="section-29-7-n"><num>(n)</num><intro><p>require—</p></intro><level class="para2" eId="section-29-7-n-i"><num>(i)</num><content><p>arrangements to be made, by the person providing, or managing the provision of, a care service, for dealing with complaints made by or on behalf of those provided with, or seeking to be provided with, that service; and</p></content></level><level class="para2" eId="section-29-7-n-ii"><num>(ii)</num><content><p>that person to take steps to publicise such arrangements; or</p></content></level></level><level class="para1" eId="section-29-7-o"><num>(o)</num><intro><p>require a person who provides, or manages, an independent health care service, to make arrangements for securing that—</p></intro><level class="para2" eId="section-29-7-o-i"><num>(i)</num><content><p>any medical or psychiatric treatments; or</p></content></level><level class="para2" eId="section-29-7-o-ii"><num>(ii)</num><content><p>services such as are mentioned in subsection (8) below,</p></content></level><wrapUp><p>provided in or for the purposes of the hospital or clinic or (as the case may be) for the purposes of the agency, are of appropriate quality and meet appropriate standards.</p></wrapUp></level></subsection><subsection eId="section-29-8"><num>(8)</num><intro><p>For the purposes of subsection (7)(o)(ii) above, the services are—</p></intro><level class="para1" eId="section-29-8-a"><num>(a)</num><intro><p>medical treatment under—</p></intro><level class="para2" eId="section-29-8-a-i"><num>(i)</num><content><p>anaesthesia; or</p></content></level><level class="para2" eId="section-29-8-a-ii"><num>(ii)</num><content><p>sedation;</p></content></level></level><level class="para1" eId="section-29-8-b"><num>(b)</num><intro><p>dental treatment under—</p></intro><level class="para2" eId="section-29-8-b-i"><num>(i)</num><content><p>general anaesthesia; or</p></content></level><level class="para2" eId="section-29-8-b-ii"><num>(ii)</num><content><p>sedation;</p></content></level></level><level class="para1" eId="section-29-8-c"><num>(c)</num><content><p>palliative care;</p></content></level><level class="para1" eId="section-29-8-d"><num>(d)</num><content><p>obstetric services and, in connection with childbirth, medical services;</p></content></level><level class="para1" eId="section-29-8-e"><num>(e)</num><content><p>termination of pregnancies;</p></content></level><level class="para1" eId="section-29-8-f"><num>(f)</num><content><p>cosmetic surgery; and</p></content></level><level class="para1" eId="section-29-8-g"><num>(g)</num><intro><p>treatment using such—</p></intro><level class="para2" eId="section-29-8-g-i"><num>(i)</num><content><p>techniques; or</p></content></level><level class="para2" eId="section-29-8-g-ii"><num>(ii)</num><content><p>technology,</p></content></level><wrapUp><p>as may be specified in the regulations.</p></wrapUp></level></subsection><subsection eId="section-29-9"><num>(9)</num><intro><p>Regulations may make provision—</p></intro><level class="para1" eId="section-29-9-a"><num>(a)</num><content><p>requiring the approval of the Scottish Ministers for the provision and use of accommodation for the purpose of restricting the liberty of children in residential premises where care services are provided; and</p></content></level><level class="para1" eId="section-29-9-b"><num>(b)</num><content><p>imposing other requirements as to the placing of a child in accommodation provided for the purpose mentioned in paragraph (a) above, including a requirement to obtain the permission of any local authority who are looking after the child (“looking after” being construed in accordance with section 17(6) of the Children (Scotland) Act <ref eId="c00021" href="http://www.legislation.gov.uk/id/ukpga/1995/36">1995 (c. 36)</ref>).</p></content></level></subsection><subsection eId="section-29-10"><num>(10)</num><intro><p>Regulations under any of subsections (1), (2), (7) and (9) above may make it an offence to contravene or fail to comply with—</p></intro><level class="para1" eId="section-29-10-a"><num>(a)</num><content><p>any specified provision of the regulations; or</p></content></level><level class="para1" eId="section-29-10-b"><num>(b)</num><content><p>a condition of registration for the time being in force.</p></content></level></subsection><subsection eId="section-29-11"><num>(11)</num><content><p>A person guilty of an offence under the regulations shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale.</p></content></subsection><subsection eId="section-29-12"><num>(12)</num><content><p>Before the Scottish Ministers make regulations under any of subsections (1), (2), (7) and (9) above, they shall consult such persons, or groups of persons, as they consider appropriate.</p></content></subsection><subsection eId="section-29-13"><num>(13)</num><content><p>Regulations under any of subsections (1), (2), (7) and (9) above may make different provision for different
