<Pnumber>1</Pnumber>
<P2para>
<Text>It shall be an offence for a person to engage in conduct ancillary to an act that constitutes—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/asp/2001/13/section/2/1/a/made" IdURI="http://www.legislation.gov.uk/id/asp/2001/13/section/2/1/a" id="section-2-1-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>an offence under section 1(1) of this Act; or</Text>
</P3para>

<Pnumber>2</Pnumber>

<Text>Subsection (1) above applies where the conduct in question consists of or includes an act committed outwith Scotland by a United Kingdom national or a United Kingdom resident.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/asp/2001/13/section/2/3/made" IdURI="http://www.legislation.gov.uk/id/asp/2001/13/section/2/3" id="section-2-3">
<Pnumber>3</Pnumber>
<P2para>
<Text>It shall be an offence for a person to engage in conduct ancillary to an act committed (or intended to be committed) outwith Scotland by a person other than a United Kingdom national or a United Kingdom resident that, if the act were committed in Scotland (or were committed by a United Kingdom national or a United Kingdom resident), would constitute—</Text>

<Pnumber>a</Pnumber>

<Text>an offence under section 1(1) of this Act; or</Text>

<Text>an offence under this section.</Text>

<Text>Subsection (3) above applies where the conduct in question consists of or includes an act committed—</Text>

<Pnumber>a</Pnumber>

<Text>in Scotland; or</Text>

<Pnumber>b</Pnumber>
<P3para>
<Text>outwith the United Kingdom by a United Kingdom national or a United Kingdom resident.</Text>
</P3para>
</P3>
</P2para>
</P2>

<Pnumber>5</Pnumber>
<P2para>
<Text>The references in subsections (1) and (3) above to conduct ancillary to an act are to conduct that would constitute an ancillary offence in relation to that act if—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/asp/2001/13/section/2/5/a/made" IdURI="http://www.legislation.gov.uk/id/asp/2001/13/section/2/5/a" id="section-2-5-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>that conduct consisted of or included an act committed in Scotland; and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/asp/2001/13/section/2/5/b/made" IdURI="http://www.legislation.gov.uk/id/asp/2001/13/section/2/5/b" id="section-2-5-b">
<Pnumber>b</Pnumber>

<Text>that act were committed in Scotland.</Text>
