http://www.legislation.gov.uk/asp/2001/13/section/12/2002-11-01International Criminal Court (Scotland) Act 2001An Act of the Scottish Parliament to make provision for offences under the law of Scotland corresponding to offences within the jurisdiction of the International Criminal Court; to enable assistance to be provided to that court in relation to investigations and prosecutions; to make provision in relation to the enforcement of sentences and orders of that court; and for connected purposes.01-10-10texttext/xmlenStatute Law Database2024-02-192002-11-01 Part 2 121This section applies where the Scottish Ministers receive a request from the ICC for assistance in questioning a person being investigated or prosecuted.2The person concerned shall not be questioned in pursuance of the request unless—athe person has been informed of the rights set out in article 55 (rights of persons during an investigation under the Statute of the ICC);bthe fact that the person has been so informed has been recorded in writing; andcthe person consents to be interviewed.3The provisions of article 55 are set out in schedule 3 to this Act.4Consent for the purposes of subsection (2)(c) above may be given orally or in writing; but if given orally it shall be recorded in writing as soon as is reasonably practicable.
