<Text>“war crime” means a war crime as defined in article 8.2.</Text>

<Text>It shall be an offence for a person to engage in conduct ancillary to an act that constitutes—</Text>

<Text>It shall be an offence for a person to engage in conduct ancillary to an act committed (or intended to be committed) outwith Scotland by a person other than a United Kingdom national or a United Kingdom resident that, if the act were committed in Scotland (or were committed by a United Kingdom national or a United Kingdom resident), would constitute—</Text>

<Text>The references in subsections (1) and (3) above to conduct ancillary to an act are to conduct that would constitute an ancillary offence in relation to that act if—</Text>

<Title>Trial and punishment of main offences</Title>

<Text>The offence shall be triable only on indictment.</Text>

<Text>If an offence is committed outwith Scotland proceedings may be taken in any place in Scotland; and the offence may for incidental purposes be treated as having been committed in that place.</Text>

<Pnumber>4</Pnumber>

<Text>A person convicted of—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>an offence involving murder; or</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/asp/2001/13/section/3/4/b/made" IdURI="http://www.legislation.gov.uk/id/asp/2001/13/section/3/4/b" id="section-3-4-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>an offence ancillary to an offence involving murder,</Text>
</P3para>
</P3>
<Text>shall be dealt with as for an offence of murder or, as the case may be, the corresponding ancillary offence in relation to murder.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/asp/2001/13/section/3/5/made" IdURI="http://www.legislation.gov.uk/id/asp/2001/13/section/3/5" id="section-3-5">
<Pnumber>5</Pnumber>

<Text>Any person convicted of an offence (other than an offence involving murder or an offence ancillary to an offence involving murder) shall be liable to imprisonment for a term not exceeding 30 years.</Text>
</P2para>

<Text>In this section “murder” means the killing of a person in such circumstances as would, if committed in Scotland, constitute murder.</Text>

<Title>Offences in relation to the <Abbreviation Expansion="International Criminal Court">ICC</Abbreviation></Title>

<Text>A person intentionally committing any of the acts mentioned in article 70.1 (offences against the administration of justice) may be dealt with as for the corresponding offence under the law of Scotland committed in relation to the High Court of Justiciary or the Court of Session.</Text>
</P2para>
</P2>

<Title>Responsibility of military commanders and other superiors</Title>

<Text>This section applies in relation to—</Text>

<Text>A military commander, or a person effectively acting as a military commander, shall be responsible for offences committed by forces under his effective command and control, or (as the case may be) his effective authority and control, as a result of his failure to exercise control properly over such forces where—</Text>

<Pnumber>a</Pnumber>

<Text>he either knew or, owing to the circumstances at the time, should have known that the forces were committing or about to commit such offences; and</Text>
</P3para>
</P3>

<Text>he failed to take all necessary and reasonable measures within his power to prevent or repress their commission or to submit the matter to the competent authorities for investigation and prosecution.</Text>

<Text>With respect to superior and subordinate relationships not described in subsection (2) above, a superior shall be responsible for offences committed by subordinates under his effective authority and control, as a result of his failure to exercise control properly over such subordinates where—</Text>

<Text>he either knew, or consciously disregarded information which clearly indicated, that the subordinates were committing or about to commit such offences;</Text>

<Text>In determining whether an offence under this Part of this Act has been committed the court shall apply the principles of the law of Scotland.</Text>

<Text>Nothing in this Part of this Act shall be read as restricting the operation of any enactment or rule of law relating to—</Text>

<Title>Amendment of Criminal Procedure (Scotland) Act 1995</Title>

<Text>In section 274(2) of the Criminal Procedure (Scotland) Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1995/46" id="c00004" Class="UnitedKingdomPublicGeneralAct" Year="1995" Number="0046">1995 (c. 46)</Citation> (which specifies the sexual offences in respect of which certain evidence is not admissible)—</Text>

<Text>conduct constituting any of the offences mentioned in paragraphs (a) to (h) above; or</Text>
