CHAPTER 1 SCOTTISH SECURE TENANCIES

Repairs and improvements

27 Repairs

(1)

Schedule 4, which makes provision about the landlord’s obligations to repair a house let under a Scottish secure tenancy, has effect.

(2)

The Scottish Ministers may F1by regulations make provision for or in connection with entitling a tenant under a Scottish secure tenancy whose landlord is a landlord specified in the regulations to have qualifying repairs carried out to the house which is the subject of the tenancy.

(3)

F2Regulations under subsection (2) may, in particular, make provision for or in connection with—

(a)

the maximum amount payable in respect of any single qualifying repair,

F3(aa)

the period within which an inspection of the house is to take place to determine whether a qualifying repair is required,

(ab)

the period within which a qualifying repair is to be commenced,

(b)

the period within which a qualifying repair is to be completed, F4...

(c)

the repairs which are qualifying repairs for the purposes of this section,

F5(d)

compensation payable in relation to a failure to comply with a requirement imposed by the regulations,

(e)

any review or appeal in relation to a failure to comply with a requirement imposed by the regulations.
