35 Councils’ duties to children

It is the duty of a council, in the performance of those of its functions which relate principally to children, to have regard to—

a

the value of stable family life in a child’s development; and

b

the need to ensure that the content of instruction provided in the performance of those functions is appropriate, having regard to each child’s age, understanding and stage of development.

In this section—

  • children” means persons of school age within the meaning of section 31 of the Education (Scotland) Act 1980 (c.44) and “child’s” in subsection (1)(b) is to be construed accordingly;

  • council” has the same meaning as in Parts 1 and 2 of this Act.
