to promote the use of British Sign Language in Wales.</p></longTitle><block name="dateOfEnactment" refersTo="#date-enacted"><docDate date="2026-04-27">[27 April 2026]</docDate></block></preface><preamble><p><b>Having been passed by Senedd Cymru and having received the assent of His Majesty, it is enacted as follows:</b></p></preamble><body eId="body"><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-introduction"><heading>Introduction</heading><section eId="section-1"><num>1</num><heading>British Sign Language</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>References in this Act to “BSL” are to—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content><p>the visual form of British Sign Language, and</p></content></level><level class="para1" eId="section-1-1-b"><num>(b)</num><content><p>the tactile form of British Sign Language used and understood by some deafblind people.</p></content></level></subsection><subsection eId="section-1-2"><num>(2)</num><content><p>But the references to BSL in sections 3(4)(b), 4(3)(b), 5(8), 7(2), 8(3)(c), and paragraph 1 of the Schedule, are to the visual form only.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-promoting-bsl"><heading>Promoting BSL</heading><section eId="section-2"><num>2</num><heading>Welsh Ministers’ duty to promote BSL</heading><content><p>The Welsh Ministers must promote and facilitate the use of BSL.</p></content></section><section eId="section-3"><num>3</num><heading>National BSL strategy</heading><subsection eId="section-3-1"><num>(1)</num><content><p>In order to fulfil the duty under section 2, the Welsh Ministers must prepare and publish a national strategy (a “BSL strategy”).</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><intro><p>The BSL strategy must—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><intro><p>describe how the Welsh Ministers intend to—</p></intro><level class="para2" eId="section-3-2-a-i"><num>(i)</num><content><p>promote and facilitate the use of BSL in the exercise of their functions;</p></content></level><level class="para2" eId="section-3-2-a-ii"><num>(ii)</num><content><p>encourage listed public bodies to promote and facilitate the use of BSL in the exercise of their functions (including by giving guidance under section 4);</p></content></level></level><level class="para1" eId="section-3-2-b"><num>(b)</num><intro><p>include targets to increase or maintain—</p></intro><level class="para2" eId="section-3-2-b-i"><num>(i)</num><content><p>the number of BSL translators and interpreters available for the purpose of exercising the functions mentioned in paragraph (a), and</p></content></level><level class="para2" eId="section-3-2-b-ii"><num>(ii)</num><content><p>the number of persons available for the purpose of teaching and assessing those BSL translators and interpreters;</p></content></level></level><level class="para1" eId="section-3-2-c"><num>(c)</num><content><p>set out what information about the use of BSL in Wales was obtained and considered for the purpose of preparing the strategy.</p></content></level></subsection><subsection eId="section-3-3"><num>(3)</num><intro><p>The Welsh Ministers must—</p></intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content><p>publish the BSL strategy within 18 months beginning with the day after the date on which this Act is brought into force;</p></content></level><level class="para1" eId="section-3-3-b"><num>(b)</num><content><p>review the BSL strategy at least once in every period of 6 years beginning with the day after the strategy is first published and, if they revise it, publish the revised version.</p></content></level></subsection><subsection eId="section-3-4"><num>(4)</num><intro><p>The Welsh Ministers must—</p></intro><level class="para1" eId="section-3-4-a"><num>(a)</num><content><p>lay the BSL strategy, and any revised version of it, before Senedd Cymru, and</p></content></level><level class="para1" eId="section-3-4-b"><num>(b)</num><content><p>ensure that it is available in BSL.</p></content></level></subsection><subsection eId="section-3-5"><num>(5)</num><intro><p>In preparing the BSL strategy, and any revised version of it, the Welsh Ministers must involve—</p></intro><level class="para1" eId="section-3-5-a"><num>(a)</num><content><p>the BSL adviser (see section 6),</p></content></level><level class="para1" eId="section-3-5-b"><num>(b)</num><content><p>such representatives of BSL signers as the Welsh Ministers consider appropriate, and</p></content></level><level class="para1" eId="section-3-5-c"><num>(c)</num><content><p>any other persons the Welsh Ministers consider appropriate.</p></content></level></subsection><subsection eId="section-3-6"><num>(6)</num><intro><p>The requirement to involve the persons mentioned in subsection (5) includes—</p></intro><level class="para1" eId="section-3-6-a"><num>(a)</num><content><p>providing them with an opportunity to make representations about the content at the beginning of the process,</p></content></level><level class="para1" eId="section-3-6-b"><num>(b)</num><content><p>seeking their views at a formative stage of preparing a draft proposal, and</p></content></level><level class="para1" eId="section-3-6-c"><num>(c)</num><intro><p>otherwise involving them throughout the process by—</p></intro><level class="para2" eId="section-3-6-c-i"><num>(i)</num><content><p>providing sufficient information to enable them to properly consider what is proposed, and</p></content></level><level class="para2" eId="section-3-6-c-ii"><num>(ii)</num><content><p>providing sufficient time to enable them to adequately consider what is proposed and respond.</p></content></level></level></subsection></section><section eId="section-4"><num>4</num><heading>BSL guidance</heading><subsection eId="section-4-1"><num>(1)</num><content><p>The Welsh Ministers must issue guidance to listed public bodies about how they may promote and facilitate the use of BSL in the exercise of their functions.</p></content></subsection><subsection eId="section-4-2"><num>(2)</num><intro><p>In relation to the guidance referred to in subsection (1), the Welsh Ministers—</p></intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content><p>must issue the guidance no later than the date on which the BSL strategy is published in accordance with section 3(3), and</p></content></level><level class="para1" eId="section-4-2-b"><num>(b)</num><content><p>may issue revised guidance at any time.</p></content></level></subsection><subsection eId="section-4-3"><num>(3)</num><intro><p>The Welsh Ministers must—</p></intro><level class="para1" eId="section-4-3-a"><num>(a)</num><content><p>publish any guidance issued in accordance with this section, and</p></content></level><level class="para1" eId="section-4-3-b"><num>(b)</num><content><p>ensure that it is available in BSL.</p></content></level></subsection><subsection eId="section-4-4"><num>(4)</num><intro><p>Before issuing the guidance, the Welsh Ministers must consult—</p></intro><level class="para1" eId="section-4-4-a"><num>(a)</num><content><p>the BSL adviser,</p></content></level><level class="para1" eId="section-4-4-b"><num>(b)</num><content><p>such representatives of BSL signers as the Welsh Ministers consider appropriate, and</p></content></level><level class="para1" eId="section-4-4-c"><num>(c)</num><content><p>any other persons the Welsh Ministers consider appropriate.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-listed-public-body-bsl-plans"><heading>Listed public body BSL plans</heading><section eId="section-5"><num>5</num><heading>BSL plans</heading><subsection eId="section-5-1"><num>(1)</num><intro><p>A listed public body must prepare and publish a BSL plan that—</p></intro><level class="para1" eId="section-5-1-a"><num>(a)</num><content><p>describes how it intends to promote and facilitate the use of BSL in the exercise of its functions;</p></content></level><level class="para1" eId="section-5-1-b"><num>(b)</num><content><p>describes how it intends to follow guidance issued under section 4, or explains why it does not intend to do so;</p></content></level><level class="para1" eId="section-5-1-c"><num>(c)</num><content><p>contains such other information as the Welsh Ministers may prescribe by regulations.</p></content></level></subsection><subsection eId="section-5-2"><num>(2)</num><content><p>The listed public body must publish its plan within 12 months beginning with the day after the BSL strategy is published in accordance with section 3(3)(a).</p></content></subsection><subsection eId="section-5-3"><num>(3)</num><intro><p>The listed public body must review its plan—</p></intro><level class="para1" eId="section-5-3-a"><num>(a)</num><content><p>if directed to do so by the Welsh Ministers;</p></content></level><level class="para1" eId="section-5-3-b"><num>(b)</num><content><p>after any revised version of the BSL strategy is published.</p></content></level></subsection><subsection eId="section-5-4"><num>(4)</num><content><p>A direction under subsection (3)(a) must state the reasons for giving the direction.</p></content></subsection><subsection eId="section-5-5"><num>(5)</num><content><p>If the listed public body decides to revise its plan following a review, it must publish the revised version of the plan as soon as is reasonably practicable.</p></content></subsection><subsection eId="section-5-6"><num>(6)</num><intro><p>In preparing its plan or any revised version of it, the listed public body must involve—</p></intro><level class="para1" eId="section-5-6-a"><num>(a)</num><content><p>such representatives of BSL signers as it considers appropriate, and</p></content></level><level class="para1" eId="section-5-6-b"><num>(b)</num><content><p>any other persons it considers appropriate.</p></content></level></subsection><subsection eId="section-5-7"><num>(7)</num><intro><p>The requirement to involve the persons mentioned in subsection (6) includes—</p></intro><level class="para1" eId="section-5-7-a"><num>(a)</num><content><p>providing them with an opportunity to make representations about the content at the beginning of the process,</p></content></level><level class="para1" eId="section-5-7-b"><num>(b)</num><content><p>seeking their views at a formative stage of preparing a draft proposal, and</p></content></level><level class="para1" eId="section-5-7-c"><num>(c)</num><intro><p>otherwise involving them throughout the process by—</p></intro><level class="para2" eId="section-5-7-c-i"><num>(i)</num><content><p>providing sufficient information to enable them to properly consider what is proposed, and</p></content></level><level class="para2" eId="section-5-7-c-ii"><num>(ii)</num><content><p>providing sufficient time to enable them to adequately consider what is proposed and respond.</p></content></level></level></subsection><subsection eId="section-5-8"><num>(8)</num><content><p>The listed public body must send any plan published under this section to the Welsh Ministers and ensure that it is available in BSL.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-adviser-to-the-welsh-ministers"><heading>Adviser to the Welsh Ministers</heading><section eId="section-6"><num>6</num><heading>BSL adviser</heading><subsection eId="section-6-1"><num>(1)</num><content><p>The Welsh Ministers must appoint a person as their BSL adviser, and persons to be members of a panel to assist the BSL adviser.</p></content></subsection><subsection eId="section-6-2"><num>(2)</num><intro><p>The BSL adviser may‍—</p></intro><level class="para1" eId="section-6-2-a"><num>(a)</num><content><p>provide information or advice to the Welsh Ministers in relation to their functions under this Act;</p></content></level><level class="para1" eId="section-6-2-b"><num>(b)</num><content><p>provide information or advice, with the Welsh Ministers’ agreement, to any person in relation to promoting and facilitating the use of BSL in Wales;</p></content></level><level class="para1" eId="section-6-2-c"><num>(c)</num><content><p>consult the panel in relation to any information or advice to be provided in accordance with paragraphs (a) or (b).</p></content></level></subsection><subsection eId="section-6-3"><num>(3)</num><content><p>The BSL adviser may provide the information or advice mentioned in subsection (2)(a) of the adviser’s own accord or in response to a request made by the Welsh Ministers.</p></content></subsection><subsection eId="section-6-4"><num>(4)</num><content><p>Where the BSL adviser receives a request from the Welsh Ministers under subsection (3), the adviser must provide the information or advice as soon as is reasonably practicable.</p></content></subsection><subsection eId="section-6-5"><num>(5)</num><content><p>If the BSL adviser requests that a listed public body provides the adviser with information for the purpose of the exercise of any of the adviser’s functions, the body must comply with the request unless it considers that doing so would conflict with its duties or have an adverse effect on the exercise of its functions.</p></content></subsection><subsection eId="section-6-6"><num>(6)</num><content><p>If a listed public body decides not to comply with a request under subsection (5), it must explain why to the BSL adviser in writing.</p></content></subsection><subsection eId="section-6-7"><num>(7)</num><content><p>The Schedule makes further provision about the BSL adviser and the panel.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-reporting"><heading>Reporting</heading><section eId="section-7"><num>7</num><heading>Reports by listed public bodies</heading><subsection eId="section-7-1"><num>(1)</num><intro><p>Within 12 months beginning with the day after it publishes its BSL plan under section 5 or any revised version of it, a listed public body must prepare and publish a report that—</p></intro><level class="para1" eId="section-7-1-a"><num>(a)</num><content><p>describes what it has done to implement the most recent version of the plan, and</p></content></level><level class="para1" eId="section-7-1-b"><num>(b)</num><content><p>if it has not implemented something, explains why not.</p></content></level></subsection><subsection eId="section-7-2"><num>(2)</num><content><p>The listed public body must send any report published under this section to the Welsh Ministers and ensure that it is available in BSL.</p></content></subsection></section><section eId="section-8"><num>8</num><heading>Reports by the Welsh Ministers</heading><subsection eId="section-8-1"><num>(1)</num><content><p>The Welsh Ministers must prepare and publish a report that assesses the progress made in promoting and facilitating the use of BSL in accordance with this Act.</p></content></subsection><subsection eId="section-8-2"><num>(2)</num><content><p>For the purpose of preparing the report, the Welsh Ministers must obtain appropriate information about the use of BSL in Wales on a sufficiently regular basis to enable them to assess progress.</p></content></subsection><subsection eId="section-8-3"><num>(3)</num><intro><p>The Welsh Ministers must—</p></intro><level class="para1" eId="section-8-3-a"><num>(a)</num><content><p>publish a report under subsection (1) at least once in every period of 3 years beginning with the day after the BSL strategy is first published,</p></content></level><level class="para1" eId="section-8-3-b"><num>(b)</num><content><p>lay the report before Senedd Cymru, and</p></content></level><level class="para1" eId="section-8-3-c"><num>(c)</num><content><p>ensure that the report is available in BSL.</p></content></level></subsection><subsection eId="section-8-4"><num>(4)</num><content><p>For the purpose of preparing a report under this section, the Welsh Minsters may require a listed public body to provide them with such information as they may specify in writing.</p></content></subsection><subsection eId="section-8-5"><num>(5)</num><content><p>A report published under this section must include an explanation of the consideration given by the Welsh Ministers as to whether to amend the list of public bodies referred to in section 9(1) in accordance with section 9(2).</p></content></subsection><subsection eId="section-8-6"><num>(6)</num><intro><p>In preparing a report under this section, the Welsh Ministers must consult—</p></intro><level class="para1" eId="section-8-6-a"><num>(a)</num><content><p>the BSL adviser,</p></content></level><level class="para1" eId="section-8-6-b"><num>(b)</num><content><p>such representatives of BSL signers as the Welsh Ministers consider appropriate, and</p></content></level><level class="para1" eId="section-8-6-c"><num>(c)</num><content><p>any other persons the Welsh Ministers consider appropriate.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-general"><heading>General</heading><section eId="section-9"><num>9</num><heading>Meaning of “listed public body”</heading><subsection eId="section-9-1"><num>(1)</num><intro><p>For the purposes of this Act, each of the following persons is a “listed public body”—</p></intro><level class="para1" eId="section-9-1-a"><num>(a)</num><content><p>a county council or county borough council in Wales;</p></content></level><level class="para1" eId="section-9-1-b"><num>(b)</num><content><p>a Local Health Board;</p></content></level><level class="para1" eId="section-9-1-c"><num>(c)</num><intro><p>the following NHS Trusts—</p></intro><level class="para2" eId="section-9-1-c-i"><num>(i)</num><content><p>Public Health Wales NHS Trust;</p></content></level><level class="para2" eId="section-9-1-c-ii"><num>(ii)</num><content><p>Velindre University NHS Trust;</p></content></level><level class="para2" eId="section-9-1-c-iii"><num>(iii)</num><content><p>Welsh Ambulance Services University NHS Trust;</p></content></level></level><level class="para1" eId="section-9-1-d"><num>(d)</num><intro><p>the following special health authorities established under section 22 of the National Health Service (Wales) Act <ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/2006/42">2006 (c. 42)</ref>—</p></intro><level class="para2" eId="section-9-1-d-i"><num>(i)</num><content><p>Digital Health and Care Wales;</p></content></level><level class="para2" eId="section-9-1-d-ii"><num>(ii)</num><content><p>Health Education and Improvement Wales.</p></content></level></level></subsection><subsection eId="section-9-2"><num>(2)</num><intro><p>The Welsh Ministers may by regulations amend subsection (1) by—</p></intro><level class="para1" eId="section-9-2-a"><num>(a)</num><content><p>adding a devolved Welsh authority,</p></content></level><level class="para1" eId="section-9-2-b"><num>(b)</num><content><p>removing a listed public body, or</p></content></level><level class="para1" eId="section-9-2-c"><num>(c)</num><content><p>amending the description of a listed public body.</p></content></level></subsection><subsection eId="section-9-3"><num>(3)</num><intro><p>Before making regulations that amend subsection (1), the Welsh Ministers must consult—</p></intro><level class="para1" eId="section-9-3-a"><num>(a)</num><content><p>the BSL adviser,</p></content></level><level class="para1" eId="section-9-3-b"><num>(b)</num><content><p>such representatives of BSL signers as the Welsh Ministers consider appropriate, and</p></content></level><level class="para1" eId="section-9-3-c"><num>(c)</num><content><p>any other persons the Welsh Ministers consider appropriate.</p></content></level></subsection><subsection eId="section-9-4"><num>(4)</num><content><p>In subsection (2)(a), “<term refersTo="#term-devolved-welsh-authority" eId="term-devolved-welsh-authority">devolved Welsh authority</term>” has the meaning given in section 157A of the Government of Wales Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/2006/32">2006 (c. 32)</ref>.</p></content></subsection></section><section eId="section-10"><num>10</num><heading>Regulations</heading><subsection eId="section-10-1"><num>(1)</num><intro><p>A power to make regulations under this Act—</p></intro><level class="para1" eId="section-10-1-a"><num>(a)</num><content><p>is exercisable by Welsh statutory instrument;</p></content></level><level class="para1" eId="section-10-1-b"><num>(b)</num><content><p>includes the power to make different provision for different purposes;</p></content></level><level class="para1" eId="section-10-1-c"><num>(c)</num><content><p>includes the power to make incidental, supplementary, consequential, transitory, transitional or saving provision.</p></content></level></subsection><subsection eId="section-10-2"><num>(2)</num><content><p>Regulations under section 9(2) are subject to the Senedd approval procedure.</p></content></subsection><subsection eId="section-10-3"><num>(3)</num><content><p>Regulations under section 5(1)(c) are subject to the Senedd annulment procedure.</p></content></subsection></section><section eId="section-11"><num>11</num><heading>Coming into force</heading><content><p>This Act comes into force on the day after the day this Act receives Royal Assent.</p></content></section><section eId="section-12"><num>12</num><heading>Short Title</heading><intro><p>This Act may be referred to as—</p></intro><level class="para1" eId="section-12-a"><num>(a)</num><content><p>the British Sign Language (Wales) Act 2026, or</p></content></level><level class="para1" eId="section-12-b"><num>(b)</num><content><p>Deddf Iaith Arwyddion class="referenceNote"><p>(as introduced by section 6)</p></authorialNote></num><heading>BSL ADVISER</heading><hcontainer name="crossheading" class="schGroup7" eId="d25e892"><heading>BSL adviser</heading><paragraph eId="schedule-paragraph-1" class="schProv1"><num>1</num><intro><p>The Welsh Ministers must be satisfied that the person appointed as BSL adviser—</p></intro><level class="para1" eId="schedule-paragraph-1-a"><num>(a)</num><content><p>is able to communicate effectively in BSL, and</p></content></level><level class="para1" eId="schedule-paragraph-1-b"><num>(b)</num><content><p>has appropriate personal understanding of the experiences of BSL signers.</p></content></level></paragraph><paragraph eId="schedule-paragraph-2" class="schProv1"><num>2</num><content><p>In order to be satisfied as to the matters referred to in paragraph 1, the Welsh Ministers must seek the advice of a BSL signer.</p></content></paragraph><paragraph eId="schedule-paragraph-3" class="schProv1"><num>3</num><content><p>The person appointed as BSL adviser holds office in accordance with the terms of the appointment.</p></content></paragraph><paragraph eId="schedule-paragraph-4" class="schProv1"><num>4</num><content><p>The Welsh Ministers may pay remuneration, expenses and allowances to the BSL adviser.</p></content></paragraph><paragraph eId="schedule-paragraph-5" class="schProv1"><num>5</num><intro><p>The Welsh Ministers may pay—</p></intro><level class="para1" eId="schedule-paragraph-5-a"><num>(a)</num><content><p>pensions to, or in respect of, the BSL adviser;</p></content></level><level class="para1" eId="schedule-paragraph-5-b"><num>(b)</num><content><p>amounts for or towards provision of pensions to, or in respect of, persons who have been the BSL adviser.</p></content></level></paragraph><paragraph eId="schedule-paragraph-6" class="schProv1"><num>6</num><content><p>The Welsh Ministers may provide the BSL adviser with such staff, accommodation, equipment and other facilities as the Welsh Ministers consider necessary for the exercise of the BSL adviser’s functions.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e961"><heading>Panel</heading><paragraph eId="schedule-paragraph-7" class="schProv1"><num>7</num><content><p>Before appointing a person as a member of the panel, the Welsh Ministers must consult the BSL adviser.</p></content></paragraph><paragraph eId="schedule-paragraph-8" class="schProv1"><num>8</num><content><p>A person appointed as a member of the panel holds office
