Failure to comply with requirements for applications
62Determination of appeal against notice
(1)
On an appeal under section 61, the Welsh Ministers must either—
(a)
dismiss the appeal, or
(b)
quash or vary the notice to which it relates.
(2)
The decision of the Welsh Ministers on the appeal is final.
(3)
The appeal is to be determined on the basis of representations in writing.
(4)
The appeal is to be determined by an inspector unless the Welsh Ministers direct that it is to be determined by them.
(5)
Where an inspector determines an appeal, the inspector’s decision is to be treated as the decision of the Welsh Ministers.
(6)
Schedule 2 makes further provision about the determination of appeals under this section by inspectors.
