CHAPTER 3PLANNING PERMISSION GRANTED ON APPLICATION: INTRODUCTORY
49Planning permission for development already carried out
(1)
The planning permission that may be granted on an application includes planning permission for relevant development carried out before the day the application was made.
(2)
In this section “relevant development” means development carried out—
(a)
without planning permission,
(b)
without complying with a condition subject to which planning permission was granted, or
(c)
in accordance with planning permission granted for a limited period.
(3)
Planning permission for the relevant development may be granted to have effect—
(a)
from the beginning of the day the development was carried out, or
(b)
if it was carried out in accordance with planning permission granted for a limited period, from the end of that period.
