Powers to acquire land where blight notice served
353Power of the Welsh Ministers to acquire land affected by order relating to new town
(1)
Where a blight notice has been served in respect of land falling within paragraph 5 or 6 of Schedule 19, the Welsh Ministers have power to acquire compulsorily any interest in the land in pursuance of the blight notice until a development corporation is established for the new town.
(2)
Where the Welsh Ministers acquire an interest under subsection (1)—
(a)
if the land is or becomes land falling within paragraph 6 of Schedule 19, they must, when the development corporation is established for the new town, transfer the interest to it;
(b)
in any other case, they may dispose of the interest as they think fit.
(3)
In the case of land falling within paragraph 5 of Schedule 19, the Land Compensation Act 1961 (c. 33) has effect in relation to the compensation payable in respect of the acquisition of an interest by the Welsh Ministers under subsection (1) as if the land formed part of an area designated as the site of a new town by an order that has come into operation under section 1 of the New Towns Act 1981 (c. 64).
