342Compensation: cases where prospect of planning permission to be ignored(1)

This section applies where—

(a)

an interest in land is acquired in pursuance of a blight notice,

(b)

a compulsory purchase order is in force authorising the acquisition of the interest, and

(c)

the order includes a direction that compensation is to be assessed in accordance with section 14A of the Land Compensation Act 1961 (c. 33) (cases where prospect of planning permission to be ignored).

(2)

The compensation payable for the acquisition is to be assessed—

(a)

in accordance with the direction in the compulsory purchase order, and

(b)

as if the notice to treat mentioned in section 331 or 332 had been served in pursuance of the order.
