Appropriation, disposal and development of land held by local authority for planning purposes

268Development and use of land held for planning purposes

(1)

A local authority may—

(a)

erect buildings and construct or carry out works on land to which this section applies;

(b)

repair, maintain and insure any buildings or works on land to which this section applies and generally deal with the land in a proper course of management.

(2)

This section does not—

(a)

give a local authority the power to erect a building, or to construct or carry out any works, if a power to do so is, or could be, conferred on the local authority or any other person by or under any enactment other than one mentioned in subsection (3);

(b)

authorise any act or omission on the part of a local authority that is actionable by any person.

(3)

The enactments are—

(a)

this Part;

(b)

section 2 or 5 of the Local Authorities (Land) Act 1963 (c. 29) (powers of local authorities to develop land and provide off street parking);

(c)

section 14(1) or (4) or 17(3) of the Industrial Development Act 1982 (c. 52) (powers of the Welsh Ministers and the Secretary of State to acquire and develop land in assisted areas);

(d)

section 143 of the Historic Environment Act (powers of local authorities and the Welsh Ministers to make arrangements for the management, use or disposal of buildings of special architectural or historic interest etc.).
