Where a planning authority has issued a tree replacement notice, it may waive or relax any requirement of the notice.

The authority may exercise the power in subsection (1) whether or not the notice has taken effect.

Subsection (4) applies where the planning authority had served copies of the notice under section 252(4) before exercising the power in subsection (1).

Immediately after exercising the power in subsection (1), the authority must give notice that it has done so to every person who was served with a copy of the tree replacement notice.
