Tree preservation regulations
242Compensation
(1)
Tree preservation regulations may make provision for the payment of compensation—
(a)
where any consent required under the regulations is refused;
(b)
where consent is given subject to conditions;
(c)
where any approval required by a condition is refused.
(2)
The regulations may provide for an entitlement to compensation—
(a)
to apply only in, or to apply except in, cases specified in the regulations;
(b)
to be subject to conditions, including conditions about time limits.
(3)
The regulations may make provision about—
(a)
who is to pay compensation;
(b)
who is entitled to compensation;
(c)
what compensation is to be paid for;
(d)
the amount or calculation of compensation.
(4)
The regulations may make provision about the procedure to be followed in connection with claiming compensation.
(5)
The regulations may make provision for the determination of disputes about compensation, including provision for and in connection with the referral of disputes to, and their determination by, the Upper Tribunal.
