eId="part-2-crossheading-general"><heading>General</heading><section eId="section-91" uk:target="true"><num>91</num><heading>Co-operation and co-ordination by duty holders</heading><subsection eId="section-91-1"><num>(1)</num><content><p>Subsection (2) applies where there is more than one duty holder for a relevant HMO.</p></content></subsection><subsection eId="section-91-2"><num>(2)</num><content><p>When carrying out their duties under this Act and regulations made under it, each duty holder must so far as possible co-operate and co-ordinate with every other duty holder for the relevant HMO.</p></content></subsection><subsection eId="section-91-3"><num>(3)</num><intro><p>Subsection (4) applies where—</p></intro><level class="para1" eId="section-91-3-a"><num>(a)</num><content><p>a person is a duty holder for a relevant HMO that is contained in a regulated building, and</p></content></level><level class="para1" eId="section-91-3-b"><num>(b)</num><content><p>one or more other persons are accountable persons for the regulated building.</p></content></level></subsection><subsection eId="section-91-4"><num>(4)</num><content><p>When carrying out their duties under this Act and regulations made under it, the duty holder must so far as possible co-operate and co-ordinate with each accountable person for the regulated building.</p></content></subsection><subsection eId="section-91-5"><num>(5)</num><intro><p>Subsection (6) applies where—</p></intro><level class="para1" eId="section-91-5-a"><num>(a)</num><content><p>a person is a duty holder for a relevant HMO that is contained in a category 1 building, and</p></content></level><level class="para1" eId="section-91-5-b"><num>(b)</num><content><p>a special measures order is in force in relation to the category 1 building.</p></content></level></subsection><subsection eId="section-91-6"><num>(6)</num><content><p>The duty holder must co-operate with the special measures manager appointed by the order for the purpose of the manager carrying out their functions under the order.</p></content></subsection><subsection eId="section-91-7"><num>(7)</num><intro><p>Subsection (8) applies where—</p></intro><level class="para1" eId="section-91-7-a"><num>(a)</num><content><p>a person is a duty holder for a relevant HMO that is contained in a regulated building, and</p></content></level><level class="para1" eId="section-91-7-b"><num>(b)</num><content><p>an order under section 24 of the Landlord and Tenant Act <ref eId="c00018" href="http://www.legislation.gov.uk/id/ukpga/1987/31">1987 (c. 31)</ref> is in force which appoints a manager to carry out any building safety functions in relation to the regulated building or any part of it.</p></content></level></subsection><subsection eId="section-91-8"><num>(8)</num><content><p>The duty holder must co-operate with the manager for the purpose of the manager carrying out their building safety functions under the order.</p></content></subsection><subsection eId="section-91-9"><num>(9)</num><content><p>In subsections (7) and (8), “<term refersTo="#term-building-safety-function" eId="term-building-safety-function">building safety function</term>” means a function which this Act or regulations made under it provide is to be carried out by an accountable person for the regulated building.</p></content></subsection><subsection eId="section-91-10"><num>(10)</num><intro><p>Subsection (11) applies where—</p></intro><level class="para1" eId="section-91-10-a"><num>(a)</num><content><p>a person is a duty holder for a relevant HMO, and</p></content></level><level class="para1" eId="section-91-10-b"><num>(b)</num><intro><p>one or more other persons are responsible persons for the purposes of the Fire Safety Order in relation to—</p></intro><level class="para2" eId="section-91-10-b-i"><num>(i)</num><content><p>the relevant HMO, or</p></content></level><level class="para2" eId="section-91-10-b-ii"><num>(ii)</num><content><p>if the relevant HMO forms part of a building, any other premises forming part of the building.</p></content></level></level></subsection><subsection eId="section-91-11"><num>(11)</num><content><p>The duty holder must so far as possible co-operate and co-ordinate with each responsible person for the purpose of each responsible person carrying out their duties under the Fire Safety Order.</p></content></subsection></section></hcontainer></part></body></act></akomaNtoso>
