eId="body"><part eId="part-2"><num>PART 2</num><heading>FIRE SAFETY IN CERTAIN HOUSES IN MULTIPLE OCCUPATION</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-duties-of-occupiers-of-relevant-hmos"><heading>Duties of occupiers of relevant HMOs</heading><section eId="section-89" uk:target="true"><num>89</num><heading>Entry by duty holders for purposes of assessing and managing fire safety risks</heading><subsection eId="section-89-1"><num>(1)</num><intro><p>This section applies where—</p></intro><level class="para1" eId="section-89-1-a"><num>(a)</num><content><p>a duty holder for a relevant HMO makes a request for entry to a part of the relevant HMO specified in the request (“the specified part”),</p></content></level><level class="para1" eId="section-89-1-b"><num>(b)</num><content><p>the request is made to an occupier of the specified part who is aged 18 or over,</p></content></level><level class="para1" eId="section-89-1-c"><num>(c)</num><content><p>the request is made for a purpose mentioned in subsection (2),</p></content></level><level class="para1" eId="section-89-1-d"><num>(d)</num><content><p>the request complies with subsection (3), and</p></content></level><level class="para1" eId="section-89-1-e"><num>(e)</num><content><p>entry to the specified part is not given.</p></content></level></subsection><subsection eId="section-89-2"><num>(2)</num><intro><p>The purposes are enabling the duty holder—</p></intro><level class="para1" eId="section-89-2-a"><num>(a)</num><content><p>to comply with sections 81 to 84 or regulations made under those sections (assessment of fire safety risks), where the duty holder is the landlord of the relevant HMO;</p></content></level><level class="para1" eId="section-89-2-b"><num>(b)</num><content><p>to comply with section 85 or regulations made under it (management of fire safety risks).</p></content></level></subsection><subsection eId="section-89-3"><num>(3)</num><intro><p>A request complies with this subsection if it—</p></intro><level class="para1" eId="section-89-3-a"><num>(a)</num><content><p>is in writing,</p></content></level><level class="para1" eId="section-89-3-b"><num>(b)</num><content><p>sets out the purpose for which it is made,</p></content></level><level class="para1" eId="section-89-3-c"><num>(c)</num><content><p>explains why it is necessary to enter the specified part of the relevant HMO for that purpose,</p></content></level><level class="para1" eId="section-89-3-d"><num>(d)</num><content><p>requests entry on a date, and at a time, that is reasonable, and</p></content></level><level class="para1" eId="section-89-3-e"><num>(e)</num><content><p>is given to the occupier at least 48 hours before then.</p></content></level></subsection><subsection eId="section-89-4"><num>(4)</num><content><p>The duty holder may apply to a residential property tribunal for an HMO access order.</p></content></subsection><subsection eId="section-89-5"><num>(5)</num><content><p>But a duty holder may not apply for an HMO access order unless the duty holder has given to the fire safety authority for the relevant HMO a notice setting out the intention to apply for such an order in respect of the occupier and the relevant HMO (both of which must be specified in the notice).</p></content></subsection><subsection eId="section-89-6"><num>(6)</num><intro><p>An HMO access order is an order that—</p></intro><level class="para1" eId="section-89-6-a"><num>(a)</num><content><p>requires the occupier to allow the duty holder to enter the specified part of the relevant HMO at a reasonable time for the purpose set out in the request under subsection (3)(b), and</p></content></level><level class="para1" eId="section-89-6-b"><num>(b)</num><content><p>if necessary for that purpose, authorises the person entering the specified part in accordance with the order to measure or test anything, or take samples, photographs or recordings.</p></content></level></subsection><subsection eId="section-89-7"><num>(7)</num><content><p>A residential property tribunal may make an HMO access order if satisfied that it is necessary to do so for the purpose set out in the request under section (3)(b).</p></content></subsection><subsection eId="section-89-8"><num>(8)</num><content><p>An HMO access order must specify a date on which, or a period within which, entry to the specified part of the relevant HMO may be made.</p></content></subsection></section></hcontainer></part></body></act></akomaNtoso>
