65Appeal to residential property tribunal(1)

An affected person who is dissatisfied with the outcome of a review under section 64 may appeal to a residential property tribunal against the reviewable decision.

(2)

If the outcome of the review is that the decision is varied, the right of appeal under subsection (1) is in respect of the decision as varied.

(3)

An appeal must be made to the tribunal before the end of 28 days beginning with the day after the day on which the affected person is given notice under section 64(8) or (10)(b).

(4)

The tribunal may allow an appeal to be made to it after the end of the period mentioned in subsection (3) if it is satisfied that there is a good reason for the failure to appeal before the end of that period (and for any delay in applying for permission to appeal out of time).

(5)

An appeal may be made on one or more of the following grounds—

(a)

that the decision was based on an error of fact;

(b)

that the decision was wrong in law;

(c)

that the decision was unreasonable.

(6)

In determining the appeal, the tribunal may take into account evidence that was not available to the authority.

(7)

On an appeal under this section, the tribunal may—

(a)

uphold the decision,

(b)

vary the decision, or

(c)

quash the decision.
