not being used as a residential unit</heading><subsection eId="section-103-1"><num>(1)</num><intro><p>An authorised officer may enter any premises not being used as a residential unit where—</p></intro><level class="para1" eId="section-103-1-a"><num>(a)</num><content><p>the officer considers it necessary to enter the premises for a relevant purpose, and</p></content></level><level class="para1" eId="section-103-1-b"><num>(b)</num><intro><p>unless the officer considers that it would frustrate the purpose—</p></intro><level class="para2" eId="section-103-1-b-i"><num>(i)</num><content><p>entry takes place at a reasonable time of day, and</p></content></level><level class="para2" eId="section-103-1-b-ii"><num>(ii)</num><content><p>reasonable notice is given to the occupier or‍ to a person appearing to the officer to be in charge of the premises.</p></content></level></level></subsection><subsection eId="section-103-2"><num>(2)</num><intro><p>An authorised officer may enter any premises not being used as a residential unit by force (if necessary) where—</p></intro><level class="para1" eId="section-103-2-a"><num>(a)</num><content><p>the officer considers that it is necessary to enter the premises for a relevant purpose, and</p></content></level><level class="para1" eId="section-103-2-b"><num>(b)</num><content><p>a warrant has been issued by a justice of the peace under subsection (3).</p></content></level></subsection><subsection eId="section-103-3"><num>(3)</num><intro><p>A justice of the peace may issue a warrant under this subsection only if satisfied, on sworn information in writing from an authorised officer—</p></intro><level class="para1" eId="section-103-3-a"><num>(a)</num><content><p>that it is necessary for an authorised officer to gain entry for a relevant purpose, and</p></content></level><level class="para1" eId="section-103-3-b"><num>(b)</num><intro><p>that either of the following is the case—</p></intro><level class="para2" eId="section-103-3-b-i"><num>(i)</num><content><p>entry has been, or is likely to be, refused, or</p></content></level><level class="para2" eId="section-103-3-b-ii"><num>(ii)</num><content><p>it is otherwise appropriate for the officer to be authorised to enter by force (if necessary).</p></content></level></level></subsection><subsection eId="section-103-4"><num>(4)</num><intro><p>A warrant issued under subsection (3)—</p></intro><level class="para1" eId="section-103-4-a"><num>(a)</num><content><p>authorises an authorised officer to enter premises specified in the warrant by force (if necessary);</p></content></level><level class="para1" eId="section-103-4-b"><num>(b)</num><content><p>may specify when, or how often, entry may take place.</p></content></level></subsection><subsection eId="section-103-5"><num>(5)</num><content><p>In this section and section 104, “<term refersTo="#term-residential-unit" eId="term-residential-unit">residential unit</term>” includes premises that would be a residential unit but for regulations made under section
