34Meaning of “failing to comply with environmental law”
In this Part, references to a public authority failing to comply with environmental law are references to the authority—
(a)
exercising its functions in a way that is contrary to environmental law, or
(b)
failing to exercise its functions where the failure is contrary to environmental law.
