(1)Os yw Gweinidogion Cymru yn ystyried bod y gofynion yn is-adran (3) wedi eu bodloni, cânt (pa un ai at ddibenion cyflawni eu dyletswydd o dan adran 5(1)(c) mewn perthynas â gwasanaeth bysiau lleol, neu fel arall) roi trwydded o dan yr adran hon i berson o fewn is-adran (4).
(2)Trwydded yw trwydded a roddir o dan yr adran hon (y cyfeirir ati yn y Ddeddf hon fel “trwydded gwasanaeth bysiau lleol”), mewn perthynas â gwasanaeth bysiau lleol, y mae’r person y rhoddir y drwydded iddo wedi ei awdurdodi oddi tani i ddarparu’r gwasanaeth yn ystod y cyfnod y mae’r drwydded yn cael effaith.
(3)Y gofynion yw na fyddai caniatáu’r drwydded—
(a)yn cael effaith andwyol sylweddol ar wasanaeth bysiau lleol a ddarperir o dan gontract gwasanaeth bysiau lleol, neu a ddarperir gan Weinidogion Cymru o dan adran 18;
(b)yn anghyson â’r polisïau a’r cynigion a nodir yn Strategaeth Drafnidiaeth Cymru.
(4)Y personau o fewn yr is-adran hon yw—
(a)person sy’n ddeiliad trwydded bysiau cymunedol;
(b)person sy’n ddeiliad trwydded gweithredwr cerbydau gwasanaeth cyhoeddus.
(5)Nid yw’r cyfeiriad yn is-adran (4)(b) at drwydded gweithredwr cerbydau gwasanaeth cyhoeddus yn cynnwys—
(a)trwydded y mae amod ynghlwm wrthi o dan adran 26(1A) o Ddeddf 1985 (pŵer comisiynydd traffig i roi amodau ynghlwm wrth drwyddedau) sy’n gwahardd y deiliad rhag defnyddio cerbydau o dan y drwydded i ddarparu gwasanaethau bysiau lleol o bob disgrifiad, neu o ddisgrifiad a bennir yn yr amod;
(b)trwydded sydd wedi ei hatal dros dro o dan adran 17(2) o Ddeddf 1981 neu adran 28(2) o Ddeddf 1985.
(6)Caiff Gweinidogion Cymru roi trwydded y mae amodau ynghlwm wrthi (am ddarpariaeth bellach ynghylch amodau gweler adran 14).
