Offences
32Regulated visitor accommodation at unlicensed premises: offence
(1)
It is an offence for a person to provide regulated visitor accommodation, in the course of trade or business, at any premises unless—
(a)
the person holds a visitor accommodation licence in respect of the premises that relates to the regulated visitor accommodation;
(b)
where the person does not hold a visitor accommodation licence in respect of the premises that relates to the regulated visitor accommodation, the person provides the accommodation with the permission of a person (“P”) that holds such a licence (regardless of whether that permission was given by P or with the authority of P).
(2)
A person does not commit an offence under subsection (1) if the person had a reasonable excuse for the act or omission falling within that subsection.
(3)
A person that commits an offence under subsection (1) is liable on summary conviction to a fine.
