eId="body"><part eId="part-3"><num>PART 3</num><heading>REGULATION OF VISITOR ACCOMMODATION</heading><chapter eId="part-3-chapter-2"><num>CHAPTER 2</num><heading>LICENSING</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-3-chapter-2-crossheading-enforcement"><heading>Enforcement‍</heading><section eId="section-31" uk:target="true"><num>31</num><heading>Warrant to enter and inspect premises for enforcement purposes</heading><subsection eId="section-31-1"><num>(1)</num><intro><p>This section applies if a justice of the peace is satisfied on sworn information in writing—</p></intro><level class="para1" eId="section-31-1-a"><num>(a)</num><intro><p>where the premises are premises in relation to which a licence has been granted—</p></intro><level class="para2" eId="section-31-1-a-i"><num>(i)</num><content><p>that there are reasonable grounds for entering the premises for‍ the purpose of determining whether any of the circumstances mentioned in section 30(1)(b) have arisen, and</p></content></level><level class="para2" eId="section-31-1-a-ii"><num>(ii)</num><content><p>that admission to the premises has been refused or a refusal is reasonably expected or that giving notice to the VAP of an authorised person’s intention to enter the premises is likely to defeat the purpose of the entry, or</p></content></level></level><level class="para1" eId="section-31-1-b"><num>(b)</num><content><p>where the premises are not premises in relation to which a visitor accommodation licence has been granted, that there are reasonable grounds to believe that the premises are (or have been) used as a place a‍t which regulated visitor accommodation is (or has been) offered or provided.</p></content></level></subsection><subsection eId="section-31-2"><num>(2)</num><content><p>For the purposes of subsection (1)(a)(ii), admission to premises is to be treated as having been refused if no reply is received to a request for admission within a reasonable period.</p></content></subsection><subsection eId="section-31-3"><num>(3)</num><content><p>The justice of the peace may issue a warrant conferring a power to enter the premises on an authorised person.</p></content></subsection><subsection eId="section-31-4"><num>(4)</num><intro><p>A warrant under this section confers a power to enter premises—</p></intro><level class="para1" eId="section-31-4-a"><num>(a)</num><content><p>on one occasion only, and</p></content></level><level class="para1" eId="section-31-4-b"><num>(b)</num><content><p>only at a reasonable time, unless the case is one of urgency.</p></content></level></subsection><subsection eId="section-31-5"><num>(5)</num><intro><p>A person authorised to enter premises under a warrant—</p></intro><level class="para1" eId="section-31-5-a"><num>(a)</num><intro><p>before entering premises under the warrant, must, if asked to do so—</p></intro><level class="para2" eId="section-31-5-a-i"><num>(i)</num><content><p>show evidence of the person’s authorisation‍ by the Welsh Ministers;</p></content></level><level class="para2" eId="section-31-5-a-ii"><num>(ii)</num><content><p>produce the warrant;</p></content></level><level class="para2" eId="section-31-5-a-iii"><num>(iii)</num><content><p>state the purpose of the entry;</p></content></level></level><level class="para1" eId="section-31-5-b"><num>(b)</num><content><p>may take with them such other persons and equipment as the person considers appropriate;</p></content></level><level class="para1" eId="section-31-5-c"><num>(c)</num><content><p>may inspect, copy or take away documents found on the premises, other than any documents belonging to a visitor who is residing at the premises.</p></content></level></subsection><subsection eId="section-31-6"><num>(6)</num><intro><p>In subsection (5)(c), references to—</p></intro><level class="para1" eId="section-31-6-a"><num>(a)</num><content><p>documents include information recorded in any form;</p></content></level><level class="para1" eId="section-31-6-b"><num>(b)</num><intro><p>documents found on the premises include—</p></intro><level class="para2" eId="section-31-6-b-i"><num>(i)</num><content><p>documents stored on computers or electronic storage devices on the premises, and</p></content></level><level class="para2" eId="section-31-6-b-ii"><num>(ii)</num><content><p>documents stored elsewhere that can be accessed by computers on the premises.</p></content></level></level></subsection><subsection eId="section-31-7"><num>(7)</num><intro><p>The power conferred by subsection (5)(c) includes power—‍</p></intro><level class="para1" eId="section-31-7-a"><num>(a)</num><content><p>to impose requirements as to the form in which documents are provided (which may include requirements to provide legible copies of documents stored electronically);</p></content></level><level class="para1" eId="section-31-7-b"><num>(b)</num><content><p>to inspect a computer or other electronic storage device (other than a device belonging to a visitor) on which documents have been created or stored.</p></content></level></subsection><subsection eId="section-31-8"><num>(8)</num><content><p>A warrant under this section ceases to have effect
