eId="body"><part eId="part-3"><num>PART 3</num><heading>REGULATION OF VISITOR ACCOMMODATION</heading><chapter eId="part-3-chapter-2"><num>CHAPTER 2</num><heading>LICENSING</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-3-chapter-2-crossheading-enforcement"><heading>Enforcement‍</heading><section eId="section-30" uk:target="true"><num>30</num><heading>Power of entry and inspection for enforcement purposes</heading><subsection eId="section-30-1"><num>(1)</num><intro><p>This section applies where—</p></intro><level class="para1" eId="section-30-1-a"><num>(a)</num><content><p>a visitor accommodation licence has been granted to a VAP in respect of premises in accordance with this Part, and</p></content></level><level class="para1" eId="section-30-1-b"><num>(b)</num><intro><p>the Welsh Ministers have reasonable grounds for believing that—</p></intro><level class="para2" eId="section-30-1-b-i"><num>(i)</num><content><p>the VAP has given false or misleading information to the Welsh Ministers in relation to the licence, or</p></content></level><level class="para2" eId="section-30-1-b-ii"><num>(ii)</num><content><p>a condition of the licence has been breached.</p></content></level></level></subsection><subsection eId="section-30-2"><num>(2)</num><content><p>Where this section applies and the Welsh Ministers consider that it is necessary or expedient for the purpose of determining whether any of the circumstances mentioned in subsection (1)(b) have arisen, an authorised person may (subject to subsection (3)) enter the premises at any reasonable time.</p></content></subsection><subsection eId="section-30-3"><num>(3)</num><intro><p>An authorised person—</p></intro><level class="para1" eId="section-30-3-a"><num>(a)</num><content><p>must give reasonable notice of their intention to enter the premises to the VAP;</p></content></level><level class="para1" eId="section-30-3-b"><num>(b)</num><content><p>may not enter the premises by force under this section;</p></content></level><level class="para1" eId="section-30-3-c"><num>(c)</num><content><p>before entering premises under this section, must, if asked to do so, show evidence of the person’s authorisation‍ by the Welsh Ministers;</p></content></level><level class="para1" eId="section-30-3-d"><num>(d)</num><content><p>may take with them such other persons and equipment as the authorised person considers appropriate;</p></content></level><level class="para1" eId="section-30-3-e"><num>(e)</num><content><p>may inspect, copy or take away documents found on the premises, other than any documents belonging to a visitor who is residing at the premises.</p></content></level></subsection><subsection eId="section-30-4"><num>(4)</num><intro><p>In subsection (3)(e), references to—</p></intro><level class="para1" eId="section-30-4-a"><num>(a)</num><content><p>documents include information recorded in any form;</p></content></level><level class="para1" eId="section-30-4-b"><num>(b)</num><intro><p>documents found on the premises include—</p></intro><level class="para2" eId="section-30-4-b-i"><num>(i)</num><content><p>documents stored on computers or electronic storage devices on the premises, and</p></content></level><level class="para2" eId="section-30-4-b-ii"><num>(ii)</num><content><p>documents stored elsewhere that can be accessed by computers on the premises.</p></content></level></level></subsection><subsection eId="section-30-5"><num>(5)</num><intro><p>The power conferred by subsection (3)(e) includes power—‍</p></intro><level class="para1" eId="section-30-5-a"><num>(a)</num><content><p>to impose requirements as to the form in which documents are provided (which may include requirements to provide legible copies of documents stored electronically);</p></content></level><level class="para1" eId="section-30-5-b"><num>(b)</num><content><p>to inspect a computer or other electronic storage device (other than a device belonging to a visitor) on which documents have been created or stored.</p></content></level></subsection><subsection eId="section-30-6"><num>(6)</num><content><p>An authorised person is not liable in any civil or criminal proceedings for anything done in the purported performance of the person’s functions under this section if the court is satisfied that the act was done in good faith and that
