Defnyddir y term darpariaeth i ddisgrifio elfen ddiffiniadwy mewn darn o ddeddfwriaeth sy'n cael effaith ddeddfwriaethol – megis Rhan, Pennod neu adran. Mae fersiwn o ddarpariaeth yn rhagolygol naill ai:

  1. os nad yw'r ddarpariaeth (Rhan, Pennod neu adran) erioed wedi dod i rym neu;
  2. pan fo testun y ddarpariaeth wedi'i newid, ond nad oes dyddiad wedi'i bennu eto gan y person neu'r corff priodol i'r newidiadau hynny i ddod i rym.

Gall Gorchmynion Cychwyn a restrir yn y blwch 'Newidiadau i Ddeddfwriaeth' fel rhai sydd heb eu gwneud eto ddod â'r fersiwn ragolygol hon i rym.

Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Cofnodir newidiadau ac effeithiau gan ein tîm golygyddol mewn rhestrau sydd i'w gweld yn yr adran 'Newidiadau i Ddeddfwriaeth'. Os nad yw'r effeithiau hynny wedi'u cymhwyso eto i destun y ddeddfwriaeth gan y tîm golygyddol maent hefyd wedi'u rhestru ochr yn ochr â'r ddeddfwriaeth yn y darpariaethau yr effeithir arnynt. (1)Mae’r adran hon yn gwneud darpariaeth ynghylch yr hyfforddiant ar gyfer darparwyr llety ymwelwyr sy’n gymwys at ddibenion—

(a)yr amod y cyfeirir ato yn adran 15(3)(b), a

(b)y gofyniad cymeradwyo y cyfeirir ato yn adran 19(2)(b).

(2)Rhaid i Weinidogion Cymru drwy reoliadau ragnodi’r hyfforddiant y mae rhaid i DLlY ei gwblhau mewn perthynas ag—

(a)yr amodau trwydded y cyfeirir atynt yn adran‍ 15(1);

(b)cynnwys‍ unrhyw god ymarfer a ddyroddir gan Weinidogion Cymru o dan adran 3;

(c)unrhyw faterion eraill sy’n gysylltiedig â rheoleiddio llety ymwelwyr o dan‍ Rannau 3 i 5 o’r Ddeddf hon (neu drwy reoliadau a wneir o dan y Rhannau hynny) y mae Gweinidogion Cymru yn ystyried eu bod yn briodol.

(3)Caiff rheoliadau o dan is-adran (2)—

(a)gwneud darpariaeth wahanol mewn perthynas â darparu disgrifiadau gwahanol o lety ymwelwyr rheoleiddiedig neu â disgrifiadau gwahanol o fangre;

(b)gwneud darpariaeth wahanol mewn perthynas â disgrifiadau gwahanol o DLlY (gan gynnwys mewn perthynas ag endidau corfforaethol ac endidau anghorfforaethol);

(c)darparu ar gyfer amgylchiadau pryd nad yw’n ofynnol cwblhau hyfforddiant.

(4)Caiff rheoliadau o dan is-adran (2) hefyd wneud darpariaeth—

(a)mewn cysylltiad â hyfforddiant yn cael ei ddarparu dim ond—

(i)gan Weinidogion Cymru, neu

(ii)gan bersonau sydd wedi eu hawdurdodi gan Weinidogion Cymru;

(b)sy’n pennu’r ffioedd y caniateir eu codi neu ddull ar gyfer penderfynu’r ffioedd y caniateir eu codi—

(i)gan Weinidogion Cymru, neu bersonau sydd wedi eu hawdurdodi gan Weinidogion Cymru, am ddarparu hyfforddiant;

(ii)gan Weinidogion Cymru am awdurdodi person i ddarparu hyfforddiant.

(5)Cyn gwneud unrhyw reoliadau o dan yr adran hon, rhaid i Weinidogion Cymru ymgynghori ag unrhyw bersonau y maent yn ystyried eu bod yn briodol.
