(1)Yn y Ddeddf hon, ystyr “tomen” yw croniad neu ddyddodiad gwastraff (beth bynnag ei ffurf neu ei gyfansoddiad) o fwynglawdd neu chwarel ac eithrio croniad neu ddyddodiad sydd wedi ei leoli o dan y ddaear.
(2)Mae unrhyw wal neu strwythur arall (pa un a yw wedi ei ffurfio yn gyfan gwbl neu’n rhannol o wastraff ai peidio) sy’n cadw neu’n cyfyngu tomen i’w thrin neu i’w drin at ddibenion y Ddeddf hon fel rhan o’r domen.
(3)Yn y Ddeddf hon, ystyr “tomen nas defnyddir” yw tomen wedi ei lleoli yn gyfan gwbl neu’n rhannol yng Nghymru ac eithrio un y mae Rheoliadau Chwareli 1999 (O.S. 1999/2024) neu Reoliadau Mwyngloddiau 2014 (O.S. 2014/3248) yn gymwys iddi.
(4)Os yw’r naill neu’r llall o’r Rheoliadau a grybwyllir yn is-adran (3) yn cael ei ddirymu neu ei ddiwygio, caiff Gweinidogion Cymru ddiwygio’r adran hon drwy reoliadau i newid y diffiniad o “tomen nas defnyddir”.
(5)Caiff Gweinidogion Cymru ddarparu drwy reoliadau nad yw tomen o ddisgrifiad a ragnodir gan y rheoliadau i’w thrin, er gwaethaf is-adran (3), fel tomen nas defnyddir at ddibenion y Ddeddf hon neu unrhyw ddarpariaeth yn y Ddeddf hon a ragnodir gan y rheoliadau.
(6)Cyn gwneud rheoliadau o dan is-adran (5), rhaid i Weinidogion Cymru ymgynghori â’r personau hynny y maent yn ystyried eu bod yn briodol.
