- pan fo testun y ddarpariaeth wedi'i newid, ond nad oes dyddiad wedi'i bennu eto gan y person neu'r corff priodol i'r newidiadau hynny i ddod i rym.
Gall Gorchmynion Cychwyn a restrir yn y blwch 'Newidiadau i Ddeddfwriaeth' fel rhai sydd heb eu gwneud eto ddod â'r fersiwn ragolygol hon i rym.

Ar hyn o bryd nid oes unrhyw effeithiau heb eu gweithredu yn hysbys ar gyfer y Deddf Tomenni Mwyngloddiau a Chwareli Nas Defnyddir (Cymru) 2025, Adran 43.

(1)Mae’r adran hon yn gymwys—
(a)pan fo’r Awdurdod wedi canslo hysbysiad a roddwyd o dan adran 35, a
(b)pan fo perchennog ar dir y rhoddwyd yr hysbysiad iddo wedi mynd i wariant wrth gydymffurfio ag ef.
(2)Caiff y perchennog wneud cais i Weinidogion Cymru i gael ad-daliad gan yr Awdurdod ar gyfer—
(a)unrhyw wariant yr aed iddo gan y perchennog o ganlyniad i roi’r hysbysiad, a
(b)unrhyw wariant yr aed iddo gan y perchennog y gellir ei briodoli i ganslo’r hysbysiad (pa un a ellir ei briodoli i adfer unrhyw dir, canslo unrhyw gontract neu fel arall).
(3)Mae cais o dan yr adran hon i’w benderfynu gan berson a benodir gan Weinidogion Cymru (“person penodedig”).
(4)Caiff y person penodedig gyfarwyddo’r Awdurdod i ad-dalu i’r perchennog y cyfan neu unrhyw ran o’r gwariant y cyfeirir ato yn is-adran (2).
(5)Wrth benderfynu pa un ai i roi cyfarwyddyd o dan is-adran (4), neu i ba raddau y dylai fod yn ofynnol i’r Awdurdod ad-dalu’r perchennog, rhaid i’r person penodedig roi sylw i holl amgylchiadau’r achos ac, yn benodol, i—
(a)y seiliau y rhoddodd yr awdurdod yr hysbysiad canslo arnynt o dan adran 42, a
(b)pa un a yw’r Awdurdod wedi rhoi neu’n bwriadu rhoi hysbysiad pellach i’r perchennog o dan adran 35 neu’n bwriadu cynnal gweithrediadau ei hun o dan adran 44.
(6)Rhaid i’r Awdurdod gydymffurfio â chyfarwyddyd a roddir o dan is-adran (4).
(7)Rhaid i Weinidogion Cymru drwy reoliadau wneud darpariaeth ynghylch y weithdrefn sydd i’w dilyn wrth benderfynu ceisiadau o dan yr adran hon.
(8)Caiff Gweinidogion Cymru drwy reoliadau wneud darpariaeth arall mewn cysylltiad â phenderfynu ceisiadau o dan yr adran hon.
(9)Mae is-adrannau (3) i (5) o adran 40 yn gymwys mewn perthynas â rheoliadau o dan yr adran hon fel pe bai’r cyfeiriadau yn yr is-adrannau hynny at adran 40 yn gyfeiriadau at yr adran hon.
