(1)Rhaid i bŵer Gweinidogion Cymru i wneud rheoliadau o dan y Ddeddf hon gael ei arfer drwy offeryn statudol.
(2)Mae pŵer Gweinidogion Cymru i wneud rheoliadau o dan y Ddeddf hon yn cynnwys pŵer—
(a)i wneud darpariaeth wahanol ar gyfer ardaloedd gwahanol, blynyddoedd ysgol gwahanol, neu ddibenion gwahanol;
(b)i wneud darpariaeth wahanol yn gyffredinol neu’n ddarostyngedig i esemptiadau neu eithriadau penodedig neu mewn perthynas ag achosion penodedig;
(c)i wneud darpariaeth ddeilliadol, darpariaeth atodol, darpariaeth ganlyniadol, darpariaeth ddarfodol, darpariaeth drosiannol neu ddarpariaeth arbed.
(3)Mae’r ddarpariaeth y caniateir ei gwneud o dan is-adran (2)(c) yn cynnwys darpariaeth sy’n diwygio, yn diddymu neu’n dirymu unrhyw ddeddfiad, gan gynnwys unrhyw ddarpariaeth yn y Ddeddf hon.
(4)Ni chaniateir i offeryn statudol sy’n cynnwys un neu ragor o’r canlynol gael ei wneud oni bai bod drafft o’r offeryn wedi ei osod gerbron Senedd Cymru, ac wedi ei gymeradwyo ganddi drwy benderfyniad—
(a)rheoliadau o dan adrannau 1(2), 3(1) a 3(3), 5(2), 9(3), 10(3), 11(2)(b), (3)(b) a (c), 13, 14(4), 20(4), 24(10), 40(1), 46(8)(b), a pharagraffau 2(4) a 3(f) o Atodlen 2;
(b)rheoliadau sy’n diwygio neu’n diddymu unrhyw ddeddfiad sydd wedi ei gynnwys mewn deddfwriaeth sylfaenol (gan gynnwys unrhyw ddarpariaeth yn y Ddeddf hon).
(5)Mae unrhyw offeryn statudol arall sy’n cynnwys rheoliadau o dan y Ddeddf hon yn ddarostyngedig i’w annilysu yn unol â phenderfyniad gan Senedd Cymru.
(6)Yn is-adran (4) ystyr “deddfwriaeth sylfaenol” yw—
(a)Deddf gan Senedd Cymru;
