104Pwerau Gweinidogion Cymru i ymyrryd

(1)Caiff Gweinidogion Cymru roi cyfarwyddyd ymyrryd i brif gyngor neu mewn perthynas â phrif gyngor os ydynt yn ystyried—
(a)ei bod yn debygol nad yw’r cyngor yn bodloni’r gofynion perfformiad, neu
(b)nad yw’r cyngor yn bodloni’r gofynion perfformiad.
(2)Ond cyn rhoi cyfarwyddyd ymyrryd rhaid i Weinidogion Cymru—
(a)darparu neu geisio darparu cefnogaeth a chymorth i’r cyngor (a all gynnwys cyfarwyddo cyngor arall o dan adran 103),
(b)ymgynghori ag unrhyw bersonau y mae Gweinidogion Cymru yn ystyried ei bod yn briodol ymgynghori â hwy, ac
(c)hysbysu’r cyngor eu bod yn bwriadu rhoi’r cyfarwyddyd.
(3)Nid yw gofyniad ym mharagraff (a), (b) neu (c) o is-adran (2) yn gymwys os yw Gweinidogion Cymru yn ystyried bod angen brys i roi’r cyfarwyddyd a bod cymaint o frys fel y byddai’n briodol gwneud hynny heb gymryd y cam a nodir yn y paragraff.
(4)Yn yr adran hon ystyr “cyfarwyddyd ymyrryd” yw cyfarwyddyd o dan adran 105, 106 neu 107; ac mae’r adrannau hynny yn ddarostyngedig i is-adrannau (1) i (3) o’r adran hon.
