Any person who—

assaults any person with intent to resist or prevent the lawful apprehension of himself or of any other person for any offence;
shall be guilty of an offence and shall be liable—
- i
on conviction on indictment, to imprisonment for a term not exceeding two years or to a fine, or to both; or
- ii
on summary conviction, to imprisonment for a term not exceeding six months or to a fine not exceedingF2 level 3 on the standard scale, or to both.
