11Offences.N.I.

(1)Every person who—

(a)dredges sand, gravel, soil or any other substance within one hundred yards of any work[F1 vested in] or maintained by the Ministry …F2 under this Act,F1. . . ; or

(b)moors any vessel to or at any such work otherwise than to a post or ring specially provided by the Ministry for the mooring of vessels; or

(c)wilfully obstructs any officer or servant of the Ministry in the exercise of any powers or the performance of any duties of the Ministry under this Act, or any person engaged in the construction of any works in pursuance thereof; or

[F1(d)removes any works (whether constructed or in course of construction) which are vested in or maintained by the Department for the purposes of this Act; or]

(e)removes,F1. . . any pegs, poles or marks placed or made by any authorised person for the purpose of, or in connection with, the construction of any works as aforesaid; or

(f)places any solid matter in, or causes or permits any solid matter to fall or pass into, any watercourse in respect of which any works are about to be or are in course of being constructed[F1 by the Department]; or

(g)obstructs the flow of water to, through or from, any works[F1 vested in or maintained by the Department for the purposes of this Act] in such manner as to prevent or hinder the efficient operation thereof, or to cause flooding of such works or any lands drained thereby;

shall, without prejudice to the provisions of any byelaw in force under section fifteen, be guilty of an offence under this section.

(2)Any person guilty of an offence under this section shall be liable on summary conviction thereof to a fine not exceeding[F3 level 3 on the standard scale], or at the discretion of the court to imprisonment for any term not exceeding six months or to both such fine and imprisonment, and shall also, in the case of a continuing offence, be liable to a fine (in addition to any such fine as aforesaid) not exceeding five pounds for every day during which the offence continues.
