28Effect of repeal.N.I.

(1)The repeal of any enactment shall not be deemed to be or to involve a declaration that such enactment was or was considered by Parliament [F1or (as the case may be) the Assembly] to have been previously in force in Northern Ireland.

(2)Where an enactment repeals or revokes a [F1statutory] provision, the repeal or revocation shall not, save as in this section otherwise provided—

(a)revive any [F1statutory] provision or thing not in force or existing at the time at which the repeal or revocation takes effect;

(b)affect the previous operation of the [F1statutory] provision so repealed or revoked, or anything duly done or suffered thereunder;

(c)affect any right, privilege, obligation or liability acquired, accrued or incurred under the [F1statutory] provision so repealed or revoked;

(d)affect any offence committed against the [F1statutory] provision so repealed or revoked, or any penalty or forfeiture or punishment incurred in respect thereof; or

(e)affect any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment as aforesaid;

and any such investigation, legal proceeding or remedy may be instituted, continued or enforced, and any such penalty, forfeiture or punishment may be imposed, as if the [F1statutory] provision had not been repealed or revoked.

(3)Nothing in sub-section (2) shall be taken to authorise the continuance in force after the repeal or revocation of a [F1statutory] provision of any instrument made under that provision.

(4)Where at any time an enactment expires, lapses or otherwise ceases to have effect, this section shall apply as if that enactment had then been repealed or revoked.

(5)The inclusion in the repealing provisions of any enactment of any express saving with respect to the repeals affected thereby shall not be taken to prejudice the operation of this section with respect to the effect of those repeals.
