to amend the law relating to contributory negligence and the measure of damages for personal injury  or death; and for purposes connected with the matters aforesaid.</LongTitle><DateOfEnactment><DateText>[23rd December 1948]<CommentaryRef Ref="key-f01d584737cf06012cb56cc2e88ec068"/></DateText></DateOfEnactment></PrimaryPrelims><Body DocumentURI="http://www.legislation.gov.uk/apni/1948/23/body" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/body" NumberOfProvisions="7" RestrictStartDate="2006-01-01"><P1group RestrictStartDate="2006-01-01"><Title>Common employment not to be a defence.</Title><P1 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/1" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/1" id="section-1"><Pnumber>1</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/1/1" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/1/1" id="section-1-1"><Pnumber>1</Pnumber><P2para><Text>It shall not be a defence to an employer who is sued in respect of personal injuries caused by the negligence of a person employed by him, that that person was at the time the injuries were caused in common employment with the person injured.</Text></P2para></P2><BlockText><Para><Text><Emphasis>Subs.(2) rep. by SLR (<Acronym Expansion="Northern Ireland">NI</Acronym>) 1952</Emphasis></Text></Para></BlockText><P2 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/1/3" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/1/3" id="section-1-3"><Pnumber>3</Pnumber><P2para><Text>Any provision contained in a contract of service or apprenticeship, or in an agreement collateral thereto, (including a contract or agreement entered into before the passing of this Act) shall be void in so far as it would have the effect of excluding or limiting any liability of the employer in respect of personal injuries caused to the person employed or apprenticed by the negligence of persons in common employment with him.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2006-01-01"><Title>Apportionment of liability in tort where more than one person is at fault.</Title><P1 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/2" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/2" id="section-2"><Pnumber><CommentaryRef Ref="c19009611"/>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/2/1" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/2/1" id="section-2-1"><Pnumber><CommentaryRef Ref="c5436321"/>1</Pnumber><P2para><Text>Where any person suffers damage as the result partly of his own fault and partly of the fault of any other person or persons, a claim in respect  of that damage shall not be defeated by reason of the fault of the person suffering the damage, but the damages recoverable in respect thereof shall be reduced to such extent as the court thinks just and equitable having regard to the claimant's share in the responsibility for the damage:</Text></P2para><P2para><Text>Provided that—</Text></P2para><P2para><P3 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/2/1/a" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/2/1/a" id="section-2-1-a"><Pnumber>a</Pnumber><P3para><Text>this sub-section shall not operate to defeat any defence arising under a contract;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/2/1/b" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/2/1/b" id="section-2-1-b"><Pnumber>b</Pnumber><P3para><Text>where any contract or enactment providing for the limitation of liability is applicable to the claim, the amount of damages recoverable by the claimant by virtue of this sub-section shall not exceed the maximum limit so applicable.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/2/2" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/2/2" id="section-2-2"><Pnumber>2</Pnumber><P2para><Text>Where damages are recoverable by any person by virtue of the preceding sub-section subject to such reduction as is therein mentioned, the court shall find and record the total damages which would have been recoverable if the claimant had not been at fault.</Text></P2para></P2><BlockText><Para><Text><Emphasis>Subs.(3) rep. by 1978 c.47; Ref="c5436391"/>1</Pnumber><P2para><Text>Sections one, two and sub-section (1) of section three of this Act shall apply only where the cause of action accrues after the passing of this Act<CommentaryRef Ref="c5436401"/>; but sub-sections (4) and (5) of the said section three shall apply whether the cause of action accrued or the proceedings were commenced before or after such DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/5/1" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/5/1" id="section-5-1"><Pnumber>1</Pnumber><P2para><Text>Sections one and three of this Act shall bind the Crown as from the day<CommentaryRef Ref="c5436431"/> on which the Crown Proceedings Act, 1947 <MarginNoteRef Ref="m00002"/>, is, by virtue of an Order in Council  made under section fifty-three of the last-mentioned Act, extended to Northern Ireland.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/5/2" and three shall bind the Crown as from the day referred to in the preceding sub-section, so, however, that in relation to proceedings against the Crown the references in sub-section (1) of the said section four to the passing of this Act shall be construed as references to the said day.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2006-01-01"><Title>Interpretation.</Title><P1 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/6" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/6" id="section-6"><Pnumber>6</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/apni/1948/23/section/6/1" IdURI="http://www.legislation.gov.uk/id/apni/1948/23/section/6/1" id="section-6-1"><Pnumber><CommentaryRef Ref="c5436441"/>1</Pnumber><P2para><Text>In this Act the following expressions have the meanings hereby respectively assigned to them, that is to say—</Text></P2para><P2para><Text>“court” means, in relation to any claim, the court or arbitrator by or before whom the claim falls to be determined;</Text></P2para><P2para><Text>“damage” includes
