Newidiadau i ddeddfwriaeth:
Deddf Rhentu Cartrefi (Cymru) 2016, Paragraff 15 yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 16 Gorffennaf 2025. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Changes to Legislation
Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.
15(1)Mae adrannau 104 a 123 (amrywio rhent) yn gymwys i gontract wedi ei drosi [F1(heblaw contract a grybwyllir ym mharagraff 13B)] fel pe bai unrhyw amrywiadau yn y rhent sy’n daladwy o dan y contract cyn y diwrnod penodedig yn amrywiadau o dan ba rai bynnag o’r adrannau hynny sy’n berthnasol.
[F2(1A)Mae adrannau 104 ac 123 (amrywio’r rhent) yn gymwys i gontract wedi ei drosi y mae’r landlord oddi tano yn landlord cymunedol fel pe bai’r canlynol wedi ei roi yn lle is-adran (3)(a) ym mhob un o’r adrannau hyn—
“(a)ni chaiff yr hysbysiad cyntaf a roddir ar ôl y diwrnod penodedig bennu dyddiad sy’n gynharach na 51 o wythnosau ar ôl y dyddiad pan gafodd rhent newydd effaith ddiwethaf, a”.]
(2)Rhaid i Weinidogion Cymru wneud darpariaeth drwy reoliadau—
(a)sy’n galluogi deiliad y contract o dan gontract wedi ei drosi perthnasol, ar ôl derbyn hysbysiad o dan adran 104 neu 123, wneud cais i berson neu bersonau rhagnodedig bennu’r rhent ar gyfer yr annedd, a
(b)i’r rhent a bennir gan y person neu’r personau rhagnodedig, yn unol ag unrhyw ragdybiaethau a gaiff eu rhagnodi, fod y rhent ar gyfer yr annedd o dan y contract (oni bai bod y landlord a deiliad y contract yn cytuno fel arall).
[F3(3)Mae contract wedi ei drosi yn gontract wedi ei drosi perthnasol—
(a)os oedd, yn union cyn y diwrnod penodedig, yn denantiaeth neu’n drwydded yr oedd adran 13 o Ddeddf Tai 1988 (p. 50) (codiadau rhent o dan denantiaethau cyfnodol sicr) yn gymwys iddi,
(b)os yw’n gontract safonol cyfnodol sy’n cymryd lle contract arall F4...—
(i)sy’n codi o dan adran 184(2), neu
(ii)sydd o fewn adran 184(6),
a oedd yn union cyn y diwrnod penodedig yn denantiaeth sicr, ond nid yn denantiaeth fyrddaliol sicr, am gyfnod penodol, neu
(c)os yw’n gontract sicr a oedd yn union cyn y diwrnod penodedig yn denantiaeth sicr, ond nid yn denantiaeth fyrddaliol sicr, am gyfnod penodol.]
