53Exclusion of right to apply for registration

(1)

The Commons Act 2006 is amended as follows.

(2)

In section 15C (registration of greens: exclusions)—

(a)

in subsection (1)—

(i)

omit “in England”;

(ii)

for “Schedule 1A” substitute “ the relevant Schedule ”;

(b)

in subsection (2), after “the Table” insert “ set out in the relevant Schedule ”;

(c)

in subsections (3) and (4), for “Secretary of State” substitute “ appropriate national authority ”;

(d)

in subsection (5)—

(i)

for “Secretary of State” substitute “ appropriate national authority ”;

(ii)

for “Schedule 1A” substitute “ the relevant Schedule ”;

(e)

after subsection (8) insert—

“(9)

In this section “the relevant Schedule” means—

(a)

Schedule 1A, in relation to land in England;

(b)

Schedule 1B, in relation to land in Wales.”

(3)

After Schedule 1A (the title of which becomes “ Exclusion of right under section 15: England ”) insert the Schedule set out in Schedule 6.
