14Asesu anghenion am ofal a chymorth, cymorth i ofalwyr a gwasanaethau ataliol

(1)Rhaid i awdurdod lleol a phob Bwrdd Iechyd Lleol y mae unrhyw ran o’i ardal o fewn ardal yr awdurdod lleol, yn unol â rheoliadau, asesu ar y cyd—

(a)i ba raddau y mae pobl y mae arnynt angen gofal a chymorth yn ardal yr awdurdod lleol;

(b)i ba raddau y mae yna ofalwyr yn ardal yr awdurdod lleol y mae angen cymorth arnynt;

(c)i ba raddau y mae yna bobl yn ardal yr awdurdod lleol nad yw eu hanghenion am ofal a chymorth (neu, yn achos gofalwyr, eu hanghenion am gymorth) yn cael eu diwallu (gan yr awdurdod, y Bwrdd neu fel arall);

(d)ystod a lefel y gwasanaethau y mae eu hangen i ddiwallu anghenion gofal a chymorth pobl yn ardal yr awdurdod lleol (gan gynnwys anghenion gofalwyr am gymorth);

(e)ystod a lefel y gwasanaethau y mae eu hangen i sicrhau’r dibenion yn adran 15(2) (gwasanaethau ataliol) yn ardal yr awdurdod lleol;

(f)y camau y mae angen eu cymryd i ddarparu’r ystod a’r lefel o wasanaethau a nodir yn unol â pharagraffau (d) ac (e) drwy gyfrwng y Gymraeg.

(2)Caiff rheoliadau o dan is-adran (1), er enghraifft, ddarparu ar gyfer amseru ac adolygu asesiadau.

(3)Yn adran 40 o Ddeddf y Gwasanaeth Iechyd Gwladol (Cymru) 2006 (strategaethau iechyd a llesiant)—

(a)ar ôl is-adran (2) mewnosoder—

(2A)The responsible bodies must take into account the most recent assessment under section 14 of the Social Services and Well-being (Wales) Act 2014 (assessment of needs for care and support, support for carers and preventative services) in the formulation or review of the strategy.

(2B)The responsible bodies must jointly publish the strategy.

(2C)The Local Health Board (or Boards) responsible for the strategy must submit to the Welsh Ministers any part of the strategy which relates to the health and well-being of carers (and if more than one Board is responsible for the strategy, they must do so jointly).;

(b)yn is-adran (6), ar ôl paragraff (g) mewnosoder—

(h)the submission of the strategy or a part of the strategy, to the Welsh Ministers (including, for example, the form in which and the time by which the strategy or part is to be submitted).;

(c)yn is-adran (9), mewnosoder yn y man priodol—

  • “carer” has the same meaning as in the Social Services and Well-being (Wales) Act 2014,.

(4)Yn adran 26 o Ddeddf Plant 2004 (cynlluniau plant a phobl ifanc), ar ôl is-adran (1A) mewnosoder—

(1AA)A local authority in Wales must take into account the most recent assessment under section 14 of the Social Services and Well-being (Wales) Act 2014 (assessment of needs for care and support, support for carers and preventative services) in the preparation and review of the plan.
