Marwolaeth plentyn sy’n derbyn gofal

125Marwolaeth plant sy’n derbyn gofal gan awdurdodau lleol

(1)Os yw plentyn sy’n derbyn gofal gan awdurdod lleol yn marw—

(a)rhaid i’r awdurdod hysbysu Gweinidogion Cymru,

(b)rhaid i’r awdurdod hysbysu, i’r graddau y bo’n rhesymol ymarferol, rieni’r plentyn a phob person nad yw’n rhiant i’r plentyn ond sydd â chyfrifoldeb rhiant dros y plentyn,

(c)caiff yr awdurdod, gyda chydsyniad pob person sydd â chyfrifoldeb rhiant dros y plentyn (i’r graddau y bo’n rhesymol ymarferol i’w gael), drefnu i gorff y plentyn gael ei gladdu neu ei amlosgi, a

(d)caiff yr awdurdod, os bodlonir yr amodau a grybwyllir yn is-adran (2), wneud taliadau i unrhyw berson sydd â chyfrifoldeb rhiant dros y plentyn, neu unrhyw berthynas, gyfaill neu berson arall sy’n gysylltiedig â’r plentyn, mewn cysylltiad â theithio, cynhaliaeth neu dreuliau eraill a dynnir gan y person hwnnw wrth fod yn bresennol yn angladd y plentyn.

(2)Dyma’r amodau—

(a)ei bod yn ymddangos i’r awdurdod na fedrai’r person o dan sylw fod yn bresennol yn angladd y plentyn fel arall heb galedi ariannol gormodol, a

(b)bod yr amgylchiadau yn cyfiawnhau gwneud y taliadau.

(3)Nid yw is-adran (1) yn awdurdodi amlosgi lle nad yw’n unol ag arfer argyhoeddiad crefyddol y plentyn.

(4)Pan fo awdurdod lleol wedi arfer ei bŵer o dan is-adran (1)(c) mewn cysylltiad â phlentyn a oedd o dan 16 oed pan fu farw, caiff adennill oddi wrth unrhyw un o rieni’r plentyn unrhyw dreuliau a dynnwyd ganddo.

(5)Gellir adennill yn ddiannod fel dyled sifil unrhyw symiau y mae modd eu hadennill yn y modd hwn, ond nid yw hynny’n effeithio ar unrhyw ddull arall o’u hadennill.

(6)Nid oes dim yn yr adran hon sy’n effeithio ar unrhyw ddeddfiad sy’n rheoleiddio neu’n awdurdodi claddu, amlosgi neu gynnal archwiliad anatomegol o gorff y person ymadawedig.
