Changes to Legislation

Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Cofnodir newidiadau ac effeithiau gan ein tîm golygyddol mewn rhestrau sydd i'w gweld yn yr adran 'Newidiadau i Ddeddfwriaeth'. Os nad yw'r effeithiau hynny wedi'u cymhwyso eto i destun y ddeddfwriaeth gan y tîm golygyddol maent hefyd wedi'u rhestru ochr yn ochr â'r ddeddfwriaeth yn y darpariaethau yr effeithir arnynt.   • s. 162(4)(ga) inserted by 2022 asc 1 Sch. 4 para. 30(2)(b)
  • s. 163(4A) inserted by 2014 c. 23 s. 75(10) (Effect inserting (4) not applied at s. 163 as it appears to relate to s. 194 in view of the title of the section as cited i.e. "ordinary residence". In s. 194 another (4), identically worded, is inserted on the same date by S.I. 2016/413, regs. 2(1), 316(a))

32Dyfarnu cymhwystra ac ystyried beth i’w wneud i ddiwallu anghenionLL+C

(1)Pan fo awdurdod lleol wedi ei fodloni, ar sail asesiad o anghenion, bod ar berson anghenion am ofal a chymorth neu, os gofalwr yw’r person, bod arno anghenion am gymorth, rhaid i’r awdurdod—

(a)dyfarnu a oes unrhyw un neu rai o’r anghenion yn bodloni’r meini prawf cymhwystra;

(b)os nad yw’r anghenion yn bodloni’r meini prawf cymhwystra, ddyfarnu a yw’n angenrheidiol diwallu’r anghenion, serch hynny, i amddiffyn y person—

(i)rhag cael ei gam-drin neu ei esgeuluso, neu rhag risg o gael ei gam-drin neu ei esgeuluso (os oedolyn yw’r person);

(ii)rhag cael ei gam-drin neu ei esgeuluso, neu rhag risg o gael ei gam-drin neu ei esgeuluso, neu rhag cael, neu rhag risg o gael, ei niweidio mewn modd arall (os plentyn yw’r person);

(c)dyfarnu a yw’r anghenion yn galw am arfer unrhyw swyddogaeth sydd ganddo o dan y Ddeddf hon neu Rannau 4 neu 5 o Ddeddf Plant 1989, i’r graddau y mae’r swyddogaeth yn berthnasol i’r person hwnnw;

(d)ystyried a fyddai darparu unrhyw beth y gellir ei ddarparu yn rhinwedd adran 15 (gwasanaethau ataliol) neu 17 (gwybodaeth, cyngor a chynhorthwy) neu unrhyw beth arall a all fod ar gael yn y gymuned o fudd i’r person.

(2)Os yw awdurdod lleol yn dyfarnu bod rhaid i unrhyw anghenion gael eu diwallu, neu eu bod i’w diwallu, o dan adrannau 35 i 45, rhaid i’r awdurdod—

(a)ystyried yr hyn y gellid ei wneud i ddiwallu’r anghenion hynny;

(b)ystyried a fyddai’n gosod ffi am wneud y pethau hynny, ac os felly, dyfarnu swm y ffi honno (gweler Rhan 5).

(3)Rhaid i reoliadau wneud darpariaeth ynghylch cyflawni’r ddyletswydd o dan is-adran (1)(a).

(4)Mae anghenion yn bodloni’r meini prawf cymhwystra os ydynt—

(a)o ddisgrifiad a bennir mewn rheoliadau, neu

(b)yn rhan o gyfuniad o anghenion o ddisgrifiad a bennir felly.

(5)Caiff y rheoliadau, er enghraifft, ddisgrifio anghenion drwy gyfeirio at—

(a)yr effaith y mae’r anghenion yn ei chael ar y person o dan sylw;

(b)amgylchiadau’r person.

33Y weithdrefn ar gyfer rheoliadau o dan adran 32LL+C

(1)Cyn gwneud rheoliadau o dan adran 32(3) neu (4), rhaid i Weinidogion Cymru gymryd y camau a ganlyn.

(2)Rhaid i Weinidogion Cymru ymgynghori ar y rheoliadau drafft arfaethedig â’r canlynol—

(a)unrhyw bersonau y mae’n ymddangos iddynt fod y rheoliadau yn debygol o effeithio arnynt,

(b)unrhyw sefydliadau y mae’n ymddangos iddynt eu bod yn cynrychioli buddiannau personau y mae’r rheoliadau yn debygol o effeithio arnynt, ac

(c)unrhyw bersonau eraill y maent yn ystyried eu bod yn briodol.

(3)Rhaid i Weinidogion Cymru—

(a)rhoi cyfnod o 12 wythnos o leiaf i’r personau hynny i gyflwyno sylwadau ar y rheoliadau drafft arfaethedig,

(b)ystyried unrhyw sylwadau a gyflwynir o fewn y cyfnod hwnnw, ac

(c)cyhoeddi crynodeb o’r sylwadau hynny.

(4)Rhaid i Weinidogion Cymru osod drafft o’r rheoliadau gerbron Cynulliad Cenedlaethol Cymru.

(5)O ran y rheoliadau drafft a osodir o dan is-adran (4)—

(a)rhaid iddynt fynd gyda datganiad gan Weinidogion Cymru yn rhoi manylion unrhyw wahaniaethau rhwng y rheoliadau drafft yr ymgynghorwyd arnynt o dan is-adran (2) a’r rheoliadau drafft a osodir o dan is-adran (4), a

(b)ni chaniateir iddynt gael eu cymeradwyo drwy benderfyniad gan Gynulliad Cenedlaethol Cymru yn unol ag adran 196(6) tan ar ôl i’r cyfnod o 60 niwrnod, yn dechrau ar y diwrnod y gosodir y rheoliadau drafft, ddod i ben.

34Sut i ddiwallu anghenionLL+C

(1)Mae’r canlynol yn enghreifftiau o’r ffyrdd y caiff awdurdod lleol ddiwallu anghenion o dan adrannau 35 i 45—

(a)drwy drefnu bod person heblaw’r awdurdod yn darparu rhywbeth;

(b)drwy ddarparu rhywbeth ei hun;

(c)drwy ddarparu rhywbeth, neu drwy drefnu i rywbeth gael ei ddarparu, i berson ac eithrio’r person ag anghenion am ofal a chymorth (neu gymorth yn achos gofalwr).

(2)Mae’r canlynol yn enghreifftiau o’r hyn y gellir ei ddarparu neu ei drefnu i ddiwallu anghenion o dan adrannau 35 i 45—

(a)llety mewn cartref gofal, cartref plant neu fangre o ryw fath arall;

(b)gofal a chymorth gartref neu yn y gymuned;

(c)gwasanaethau, nwyddau a chyfleusterau;

(d)gwybodaeth a chyngor;

(e)cwnsela ac eiriolaeth;

(f)gwaith cymdeithasol;

(g)taliadau (gan gynnwys taliadau uniongyrchol);

(h)cymhorthion ac addasiadau;

(i)therapi galwedigaethol.

(3)Pan fo awdurdod lleol yn diwallu anghenion person o dan adrannau 35 i 45 drwy ddarparu neu drefnu gofal a chymorth yng nghartref y person, rhaid i’r awdurdod lleol fodloni ei hun bod unrhyw ymweliadau â chartref y person at y diben hwnnw yn ddigon hir i roi i’r person y gofal a’r cymorth sydd ei angen i ddiwallu’r anghenion dan sylw.

(4)Rhaid i gôd a ddyroddir o dan adran 145 gynnwys canllawiau ynghylch hyd ymweliadau â chartref person at y diben o roi gofal a chymorth.

(5)Gweler adrannau 47 (eithriad ar gyfer darparu gwasanaethau iechyd), 48 (eithriad ar gyfer darparu tai etc) a 49 (cyfyngiadau ar ddarparu taliadau) ar gyfer cyfyngiadau ar yr hyn y caniateir ei ddarparu neu ei drefnu i ddiwallu anghenion am ofal a chymorth a’r ffordd y caniateir ei ddarparu neu ei drefnu.
