Variation of employment contracts

This paragraph applies where there is a purported variation of the employment contract of—

a

an employee of the Auditor General;

b

an employee of the WAO whose employment transferred under paragraph 5.

The variation is void if the sole or principal reason for varying the contract is—

a

the transfer mentioned in paragraph 5(1), or

b

a reason connected with the transfer that is not an economic, technical or organisational reason entailing changes in the workforce.

Nothing in this paragraph prevents a variation if the sole or principal reason for the variation is—

a

a reason connected with the transfer that is an economic, technical or organisational reason entailing changes in the workforce, or

b

a reason unconnected with the transfer.
