The Welsh Ministers, in exercise of the powers conferred by sections 6(1)(d)(1), 11(3)(a)(iii) and 187(1) of the Regulation and Inspection of Social Care (Wales) Act 2016(2), make the following Regulations.

Title and coming into force

1.—(1) The title of these Regulations is the Regulated Services (Registration) (Wales) (Amendment) Regulations 2023.

(2) These Regulations come into force on 31 December 2023.

Amendment of the Regulated Services (Registration) (Wales) Regulations 2017

2.  The Regulated Services (Registration) (Wales) Regulations 2017(3) are amended as follows—

(a)in regulation 3(b), after “secure accommodation service” insert “, special school residential service”;

(b)in regulation 6(b), after “secure accommodation service” insert “, special school residential service”;

(c)in regulation 7(b), after “secure accommodation service” insert “, special school residential service”;

(d)in paragraph 30 of Schedule 1, after “secure accommodation service” insert “, special school residential service”;

(e)in paragraph 32 of Schedule 1, after “secure accommodation service” insert “, special school residential service”;

(f)after paragraph (ea) of Schedule 2 insert the following paragraph—

(eb)in the case of a special school residential service, a description of how the arrangements for the provision of education and the arrangements for the provision of the residential service are coordinated;;

(g)in paragraph (k) of Schedule 2, after “secure accommodation service” insert “, special school residential service”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

The Regulated Services (Registration) (Wales) Regulations 2017 (“the 2017 Regulations”) make provision about the form and content of applications for registration and applications for variation of a registration under Part 1 of the Regulation and Inspection of Social Care (Wales) Act 2016 (“the 2016 Act”).

Special school residential services are prescribed as a “regulated service” for the purposes of Part 1 of the 2016 Act by the Regulated Services (Special School Residential Services) (Wales) Regulations 2023.

These Regulations make amendments to integrate references to this new regulated service into the 2017 Regulations.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations. A copy can be obtained from the Department of Health and Social Services, Welsh Government, Cathays Park, Cardiff, CF10 3NQ and is published on www.gov.wales.

Sections 6(1)(d) and 11(3)(a)(iii) refer to “such other information as may be prescribed”. “Prescribed” is defined in section 189 of the Regulation and Inspection of Social Care (Wales) Act 2016 to mean “prescribed by regulations made by Welsh Ministers”.
