The Official Controls (Extension of Transitional Periods) (Amendment) (Wales) Regulations 2022

Coming into force

The Welsh Ministers make the following Regulations in exercise of the powers conferred by—

a

paragraph 2 of Annex 6 to Regulation (EU) 2017/625 of the European Parliament and of the Council on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products1; and

b

paragraph 11A(1) of Schedule 2 to the Trade in Animals and Related Products (Wales) Regulations 20112.

In accordance with Article 144(7) of Regulation (EU) 2017/625 of the European Parliament and of the Council on officials controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products, the Welsh Ministers, before making these Regulations, have consulted such bodies and persons as appear to the Welsh Ministers to be representative of the interests likely to be substantially affected by these Regulations and such other bodies or persons as the Welsh Ministers consider appropriate.

Title, extent, application and commencement1

The title of these Regulations is the Official Controls (Extension of Transitional Periods) (Amendment) (Wales) Regulations 2022.

a

extend to England and Wales;

b

apply in relation to Wales;

c

come into force on 30 December 2022.

Amendment to the Official Controls (Extension of Transitional Periods) Regulations 20212

The Official Controls (Extension of Transitional Periods) Regulations 20213 are amended as follows.

For regulation 2 (end of the transitional staging period) substitute—

End of the transitional staging period2

In relation to Wales, for the purposes of sub-paragraph (b) of the definition of “the transitional staging period” in paragraph 2 (interpretation) of Annex 6 to Regulation (EU) 2017/625 of the European Parliament and of the Council on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products, the appointed date is 31 January 2024.

Amendment to the Meat Preparations (Amendment and Transitory Modification) (Wales) (EU Exit) Regulations 20213

In regulation 3(1) (transitory modification of Commission Decision 2000/572/EC) of the Meat Preparations (Amendment and Transitory Modification) (Wales) (EU Exit) Regulations 20214, for “31 December 2022” substitute “31 January 2024”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Official Controls (Extension of Transitional Periods) Regulations 2021 and the Meat Preparations (Amendment and Transitory Modification) (Wales) (EU Exit) Regulations 2021.

Regulation 2 amends the Official Controls (Extension of Transitional Periods) Regulations 2021 to extend, in relation to Wales, the end date of the “transitional staging period” from 31 December 2022 to 31 January 2024.

Regulation 3 amends the Meat Preparations (Amendment and Transitory Modification) (Wales) (EU Exit) Regulations 2021 to extend the temporary suspension of the requirement for meat preparations to be deep frozen where they are imported into Wales from EEA member States, the Faroe Islands, Greenland or Switzerland, bringing it into line with the date appointed as the extended end date of the “transitional staging period” (regulation 2).

The Welsh Ministers’ code of practice on the carrying out of regulatory impact assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.
