Title, commencement and application

1.—(1) The title of these Regulations is the Education (Amendments Relating to Teacher Assessment Information) (Wales) Regulations 2018.

(2) These Regulations come into force on 31 July 2018.

(3) These Regulations apply in relation to Wales.

Education (Information About Individual Pupils) (Wales) Regulations 2007

2.  The Education (Information About Individual Pupils) (Wales) Regulations 2007(1) are amended as follows—

(a)in regulation 5(2)—

(i)omit sub-paragraph (c); and

(ii)in sub-paragraph (e) for “the Skills Funding Agency” substitute “the Education and Skills Funding Agency(2)”; and

(b)for paragraph 1 in Part 2 of Schedule 2 substitute—

1.(1) The following information—

(a)whether the pupil is or was studying towards a Welsh Baccalaureate Qualification; and

(b)the title of each learning activity the pupil is or was studying.

(2) This paragraph applies to each person who—

(a)is a pupil in the school’s sixth form during the school year in which the request for the information was made;

(b)was a pupil in the school’s sixth form at any previous time during the school year in which the request for the information was made; or

(c)was a pupil in the school’s sixth form in the year immediately preceding the school year in which the request for the information was made.

School Governors’ Annual Reports (Wales) Regulations 2011

3.  The School Governors’ Annual Reports (Wales) Regulations 2011(3) are amended as follows—

(a)in regulation 2 omit the definition of “literacy and numeracy comparative report”;

(b)in regulation 5(2)(a) omit “5,”; and

(c)in Schedule 2 omit paragraphs 5 and 5A.

Head Teacher’s Report to Parents and Adult Pupils (Wales) Regulations 2011

4.  Regulation 3 of the Head Teacher’s Report to Parents and Adult Pupils (Wales) Regulations 2011(4) are amended as follows—

(a)for paragraph (4) substitute—

(4) In the case of pupils in the fourth key stage there must be included in the report the most recent “Summary of Secondary School Performance” document published by the Welsh Ministers from time to time in relation to the school on DEWi.;

(b)in paragraph (5) for “paragraphs (3) and (4)” substitute “paragraph (3)”; and

(c)in paragraph (8)(b) for “1 and 2(4)” substitute “1, 2(4), 3(4) and 8(1) and (2)”.

School Information (Wales) Regulations 2011

5.  The School Information (Wales) Regulations 2011(5) are amended as follows—

(a)in regulation 2(1) omit the definition of “literacy and numeracy comparative report”; and

(b)in Schedule 3 omit paragraphs 27 and 31.

School Performance and Absence Targets (Wales) Regulations 2011

6.—(1) The School Performance and Absence Targets (Wales) Regulations 2011(6) are amended as follows.

(2) In regulation 2(1)—

(a)omit the definition of “to achieve the core subject indicator”;

(b)in the definition of “data set” omit “teacher assessments,”; and

(c)in the appropriate place insert—

“fourth key stage pupils” (“disgyblion cyfnod allweddol pedwar”) means pupils who are in the fourth key stage referred to in section 103(1)(d) of the 2002 Act;; and

“Year 11” (“Blwyddyn 11”) means the final school year of the fourth key stage.

(3) In regulations 3(4)(b) and 4(4)(b) for “data set” substitute “data”.

(4) In regulation 5—

(a)in paragraph (1) for “have attained the age of 15 years” substitute “are in Year 11”;

(b)in paragraph (2) for “attain the age of 16 years during the school year in which” substitute “be in Year 11 when”;

(c)in each place it occurs in paragraphs (3) and (6) and in the heading to regulation 5, for “will attain the age of 16 years” substitute “will be in Year 11”; and

(d)in paragraph (4)—

(i)omit sub-paragraphs (a) and (e); and

(ii)in sub-paragraph (b) omit “teacher assessments as set out in”.

(5) In regulation 8—

(a)in paragraph (1)(a) after “results” insert “for pupils in Year 11”;

(b)in paragraph (2)(a)(i) for “3(6)” substitute “3(5)”;

(c)in paragraph (2)(a)(iii) for “will attain the age of 16 years (as defined in regulation 5(7))” substitute “will be in Year 11 (as defined in regulation 5(6))”;

(d)in paragraph (2)(b) omit paragraphs (i) and (ii);

(e)in paragraphs (2)(b)(iii) and (3)(c) for “attained the age of 16 years” substitute “are in Year 11”;

(f)in paragraph (3) omit sub-paragraphs (a) and (b); and

(g)in paragraph (3)(c) omit paragraphs (i) and (vi).

(6) In paragraphs 1(a) and (e)(i) and 3(a) and (e)(i) of Schedule 2, after “results” insert “in Year 11”.

School Teacher Appraisal (Wales) Regulations 2011

7.—(1) The School Teacher Appraisal (Wales) Regulations 2011(7) are amended as follows.

(2) In the following regulations for “development” substitute “professional learning”—

(a)regulation 5(7);

(b)regulation 15(1)(c);

(c)regulation 17(5);

(d)regulation 29(1)(c);

(e)regulation 31(4); and

(f)regulation 44(4).

(3) In the following regulations for “development” substitute “learning”—

(a)regulation 12(7)(b);

(b)regulation 26(7)(b);

(c)regulation 39(7)(b); and

(d)regulation 42(1)(c).

(4) In the following regulations for “developmental” substitute “professional learning”—

(a)regulation 15(4);

(b)regulation 29(4); and

(c)regulation 42(4).

Government of Maintained Schools (Training Requirements for Governors) (Wales) Regulations 2013

8.—(1) In regulation 2(1) of the Government of Maintained Schools (Training Requirements for Governors) (Wales) Regulations 2013(8) (“the 2013 Regulations”) in the definition of “the school performance data training” for “January 2016 and called “Training for school governors in Wales on understanding school data”” substitute “June 2018 and called “Training for school governors in Wales on understanding school data(9)””.

(2) Paragraph (1) does not apply to a governor who, before the coming into force of these Regulations, completed the school performance data training required by the 2013 Regulations.

Welsh in Education Strategic Plans and Assessing Demand for Welsh Medium Education (Wales) Regulations 2013

9.  For regulation 8 of the Welsh in Education Strategic Plans and Assessing Demand for Welsh Medium Education (Wales) Regulations 2013(10) substitute—

8.(1) Subject to paragraph (2) the local authority must publish the plan (or revised plan) by—

(a)placing it on the local authority’s website; and

(b)making copies of the plan available for inspection by members of the public at—

(i)the local authority’s office; and

(ii)any other place it considers appropriate.

(2) A local authority must not publish the supporting information set out in paragraphs 4 and 5 of Schedule 3.

Education (School Development Plans) (Wales) Regulations 2014

10.  The Education (School Development Plans) (Wales) Regulations 2014(11) are amended as follows—

(a)in regulation 2(1) in the definition of “school comparative information” omit “teacher assessments,”; and

(b)in the Schedule, in paragraph 3 and in the heading for “development” substitute “learning”.
