3.—(1) Rhaid i Weinidogion Cymru gofrestru amrywogaeth â disgrifiad swyddogol os ydynt wedi eu bodloni—

(a)bod yr amrywogaeth yn wahanol, yn unffurf ac yn sefydlog;

(b)bod sampl o’r amrywogaeth ar gael; ac

(c)mewn perthynas ag amrywogaethau a addaswyd yn enetig, fod yr organedd a addaswyd yn enetig sy’n ffurfio’r amrywogaeth wedi ei awdurdodi i’w dyfu yn unol â Chyfarwyddeb 2001/18/EC neu Reoliad (EC) Rhif 1829/2003.

(2) Rhaid i Weinidogion Cymru dderbyn bod amrywogaeth yn wahanol, yn unffurf ac yn sefydlog ar sail canlyniadau treialon tyfu yn unol â pharagraff 6.

(3) Nid yw’n ofynnol cynnal treialon tyfu pan fo Gweinidogion Cymru wedi eu bodloni, ar sail yr wybodaeth a gyflwynir gan y cais, fod disgrifiad swyddogol a bennir gan gorff swyddogol y tu allan i Gymru yn bodloni’r amodau cofrestru sy’n ofynnol gan is-baragraff (1).

(4) Caiff Gweinidogion Cymru gofrestru amrywogaeth sydd wedi ei marchnata o fewn yr Undeb Ewropeaidd cyn 30 Medi 2012 ar yr amod bod gan yr amrywogaeth ddisgrifiad a gydnabyddir yn swyddogol.
