3.  Nid yw gweithgaredd penodedig yn cynnwys—

(a)unrhyw weithgaredd sydd i’w gyflawni fel rhan o brosiect o fath a bennir yn Atodiad I i Gyfarwyddeb y Cyngor 2011/92/EU(1)ar asesu effeithiau prosiectau cyhoeddus a phreifat penodol ar yr amgylchedd;

(b)unrhyw weithgaredd sydd i’w gyflawni fel rhan o brosiect o fath a bennir yn Atodiad II i’r Gyfarwyddeb honno, os yw’n debygol oherwydd ei faint, ei natur neu ei leoliad o effeithio’n sylweddol ar yr amgylchedd;

(c)gweithgaredd y mae asesiad o’r effaith amgylcheddol yn ofynnol mewn cysylltiad ag ef yn rhinwedd rheoliad 5 (gofyniad am asesiad drwy gytundeb) o Reoliadau Gwaith Morol (Asesu Effeithiau Amgylcheddol) 2007(2);

(d)gweithgaredd sy’n cynnwys eitemau 7 a 9 a ddisgrifir ym mharagraff 2(b) a (d);

(e)unrhyw weithgaredd neu weithgareddau, neu fwy nag un gweithgaredd gyda’i gilydd, sydd â chost amcangyfrifedig o fwy na £1,000,000.
