The Social Services Code (Role of the Director of Social Services) (Appointed Day) (Wales) Order 2016

The Welsh Ministers, in exercise of the powers conferred by section 146(4)(b) of the Social Services and Well-being (Wales) Act 2014(1), make the following Order:

Title and application

1.—(1) The title of this Order is the Social Services Code (Role of the Director of Social Services) (Appointed Day) (Wales) Order 2016.

(2) This Order applies in relation to Wales.

Appointed day

2.  The day appointed for the coming into force of the code of practice on the role of the director of social services under Part 8 of the Social Services and Well-being (Wales) Act 2014 (a copy of a draft of which was laid before the National Assembly for Wales on 28 January 2016 and issued by the Welsh Ministers on 16 March 2016) is 6 April 2016.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order appoints 6 April 2016 as the day on which the code of practice on the role of the director of social services comes into force. This code was issued by the Welsh Ministers under section 145(1) of the Social Services and Well-being (Wales) Act 2014 (“the 2014 Act”) on 16 March 2016.

The code includes requirements and guidelines in relation to the role of the director of social services, as appointed by a local authority under section 144(1) of the 2014 Act. The code also specifies the competences to be demonstrated by a director of social services for the purposes of section 144(2) of the 2014 Act.

Section 145(3) of the 2014 Act requires local authorities to act in accordance with any relevant requirements contained in a code issued under section 145(1) and to have regard to any relevant guidelines contained in it.
