The Welsh Minsters, in exercise of the powers conferred upon them by sections 108(3)(a) and (b) and (5) and 210 of the Education Act 2002(1), make the following Order:

Title, commencement and application

1.—(1) The title of this Order is the Education (National Curriculum) (Attainment Targets and Programmes of Study) (Wales) (Amendment) Order 2015 and it comes into force on 1 September 2015.

(2) This Order applies in relation to Wales.

Amendment

2.—(1) The Education (National Curriculum) (Attainment Targets and Programmes of Study) (Wales) Order 2008(2) is amended as follows.

(2) In article 2(1)—

(a)in the definition of “the English document” for “January 2008 entitled “English in the National Curriculum for Wales”” substitute “August 2015 entitled “Curriculum for Wales: Programme of Study for English - Key Stages 2-4”(3)”;

(b)in the definition of “the mathematics document” for “January 2008 entitled “Mathematics in the National Curriculum for Wales”” substitute “August 2015 entitled “Curriculum for Wales: Programme of Study for Mathematics – Key Stages 2-4”(4)”;

(c)in the definition of “the Welsh document” for “January 2008 entitled “Welsh in the National Curriculum for Wales”” substitute “August 2015 entitled “Cwricwlwm Cymru: Rhaglen Astudio ar gyfer Cymraeg – Cyfnodau Allweddol 2-4”(5)”; and

(d)after the definition of “the Welsh document” insert—

“the Welsh second language document” (“y ddogfen Cymraeg ail iaith”) means the document published by the Welsh Ministers in August 2015 entitled “Welsh second language in the National Curriculum for Wales – Key Stages 2-4”(6);.

(3) For article 15 substitute—

15.(1) The provisions relating to attainment targets and programmes of study set out in the Welsh document and the Welsh second language document have effect for the purpose of specifying the attainment targets and programmes of study in relation to Welsh.

(2) The examples printed in italics in the Welsh document and the Welsh second language document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

EXPLANATORY NOTE

(This note is not part of the Order)

Under section 108(3)(a) and (b) of the Education Act 2002 the Welsh Ministers may in respect of the second, third and fourth key stages specify, by order, such attainment targets and programmes of study in relation to each of the foundation subjects as they consider appropriate.

The Education (National Curriculum) (Attainment Targets and Programmes of Study) (Wales) Order 2008 (“the 2008 Order”) gives legal effect to 12 documents (“subject documents”) which set out the programmes of study and the attainment targets for those foundation subjects.

Article 3(1) and (2) of this Order amends the 2008 Order so as to substitute the definition for the subject document for each of the following foundation subjects—

(a)English;

(b)mathematics; and

(c)Welsh.

Article 3(2) also inserts a new definition of “the Welsh second language document”. The subject document for each of the above foundation subjects has been revised to reflect changes to the programmes of study for those subjects and the effect of this amendment is that the 2008 Order will give legal effect to the revised subject documents. The subject documents have not been revised in respect of the attainment targets.

The single subject document for Welsh given legal effect by the 2008 Order provided separate programmes of study and attainment targets for Welsh and Welsh second language. Article 3(3) amends the 2008 Order so as to provide that the separate programmes of study and attainment targets for Welsh and Welsh second language are contained in separate subject documents. The programme of study for Welsh is followed by Welsh-speaking schools and the programme of study for Welsh second language is followed by non Welsh-speaking schools.

The Welsh Ministers’ Code of Practice on the carrying out of regulatory impact assessments was considered in relation to this Order. As a result, it was not necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.
